Employee Privacy Report

The Texas Department of Criminal Justice (TDCJ) is a not-for-profit organization comprised of nine non-salaried members who are appointed by the Governor of Texas for staggered six year terms known as the Texas Board of Criminal Justice. The board is charged with governing the TDCJ, implementing policies which guide operations. There are different divisions of TDCJ and amongst those divisions is the Correctional Institutions Division of which I am employed and am tasked with the confinement and supervision of convicted felons.

Email, use within the agency includes communicating with other employees within the agency, other agencies and departments. Email is a method of communicating and documenting the communication at the same time. Clear communication is an essential function to ensure the agency works smoothly. There are 119 units across the State of Texas housing approximately 740,905 offenders (Texas Tough). Emails are sent on a daily basic communicating the needs of the agency and offenders with regard to custody, education, housing, feeding, transporting and medical needs.

On a daily basic my working environment involves interaction with offenders. Security is the most important aspect of my job. Employees must ensure offenders do not have access to offices, computers, telephones or any other sensitive information. Offices must be occupied by staff or secured. Offenders are not allowed access to computers unless in the educational department or specific job assignment such as clerk within the maintenance department. Computers utilized by offenders are not to have outside access such as internet or emailing capabilities.

Computers with email access or internet access are pass word protected with the agency assigning a user name and password to each individual user. Access is monitored and managed by the technology department. Email is strictly for business use only and personal use will result in formal disciplinary action. Internet is also strictly used for business use unless approved by the Sr. Warden of the facility. The administrator has restricted use and some areas of the internet are blocked and access is denied. Sites such as banks, yahoo mail, e-bay, music sites, Facebook, etc. are blocked sights because they are not sights which would be in any shape or form related to the correctional institute.

In addition to the outside access our agency has an intercommunication sight which provides detailed and specific information for offenders. This information includes their personal information such as age, race, sex, social security number, family history information, confinement history, gang affiliation, disciplinary history and conviction details. Specific offender information is proprietary; access to this information is restricted to administrative staff.

Often Officers feel they should have the abilities to know the offenders offense and institutional history. Staff conveys the feeling of working blind unknowing of the offenders’ capabilities. From the agencies view; all individuals do not make ethical decisions all of the time and not all individuals act professionally and treat offenders without bias. It is our job to confine and control the offenders. Their punishment is sentencing to the institution and it is not our job to continue the punishment through mistreatment. It is consensus; an offender who sexually assaulted a 3 month old child then placing her in the microwave to her death would be treated differently than the offender who broke into an uninhabited home and stole ten thousand dollars’ worth of property. Understanding people are people and do not always act professionally and with ethics it is best to restrict access to certain information.

The working environment within a correctional institute does not include privacy. There is nothing private about working with convicted felons. Being a correctional supervisor involves daily involvement and contact with these felons. Offenders work within my same work space, they live where staff works, and they eat where staff works, they go to school, they shower, and they sleep all in the same place employees’ work. Employees must stay aware of their surroundings at all times and understand there is no privacy. Everyone should know our professional, working business and no-one should know our personal, family business.

Policies within TDCJ are very specific with regard to outside communication, technology and offender information. Offender movement is strictly managed as is their communication with the outside world. Often the general public question and wonder why their family member is so strictly monitored and often complain. Offender’s mail is read and scanned for illegal activity; their phone calls are also monitored for illegal activity. The same rule applies for staff members; phone calls are monitored and mail is scanned. The reason is very simple – security. It is the agency’s job to maintain custody and control of the institute and protect public safety. While one offender may be doing time for his third DWI and has never committed an assaultive or aggressive crime there are others who are doing time for just the opposite.

TDCJ houses offenders ranging from parole obscurers to individuals who murdered multiple victims and burned their bodies to child molesters, rapist and escapees. Maintaining custody and security of technologies allows the prevention of escapes and additional crimes against society.

Policies, if not understood, can negatively affect employees in that they feel micro-managed and restricted. For a security minded individual, the policies in place regarding email and internet use are a relief. There is no temptation to violate the rule and access your personal email or to check the baseball scores. The rules are clear and to the point. There is no opportunity for misunderstanding; in addition, the consequences for violating the rules are just as clear.
