Ethical and Legal Issues Paper

How can the American Nurses Association (ANA) Code of Ethics influence a final decision in each of the case studies: Case Study A: End of life, Case Study B: Nursing Negligence?

In regard to Case Study A, the ANA has a clearly stated position on end of life care and initiating a Do Not Resuscitate (DNR) with end of life decision making. It states, “Nursing care is directed toward meeting the comprehensive needs of patients and their families across the continuum of care. This is particularly vital in the care of patients and families at the end of life to prevent and relieve the cascade of symptoms and suffering that are commonly associated with dying. Nurses are leaders and vigilant advocates for the delivery of dignified and humane care. Nurses actively participate in assessing and assuring the responsible and appropriate use of interventions in order to minimize unwarranted or unwanted treatment and patient suffering” (ANA, p.7). With this said, the code of ethics committee would expect for the nursing staff to have given all possible information regarding a DNR to the patient’s family members. Ultimately, because the patient did not have any advanced directives the final decision would be made by the husband. Had the husband been deceased then the decision would fall to the eldest living

...Applying Ethical Frameworks in Practice   Ethical dilemmas are situations that nurses frequently encounter in their profession. It can involve two or more different courses of action that can’t both be acted on, placing the agent in an uncertain position (Purtilo & Doherty, 2011). Ethical dilemmas place the agent with two different courses of action that leading to two very different outcomes. Ethical dilemmas include one’s own personal values, beliefs and sense of right and wrong. When a nurse is faced with this sort of dilemma, they will need to examine their own beliefs and values. The ethical dilemma being presented in the paper is a six year old who a minor. The physician must legally get consent from the child’s legal guardian to proceed with medical care. The person who has primary custody of the child is not the child’s biological mother and is citing her religious beliefs to denying treatment. However, the biological father lives in another state and wants to seek treatment. It is the custodial mother’s right to deny treatment, and the biological father’s right to want to seek treatment, hence both choices that can end in two very different outcomes. ...Personal Ethics Development Paper Ellen Crockett Ethics in Management February 10, 2013 Robert Deemer Personal Ethics Development Paper In researching for this paper I find there are many arguments of weather personal ethics can be taught or not, from what I have read they can be taught. According to Trevino and Nelson (2011) “Ethical behavior relies on more than good character” (p. 17). A person can have the best upbringing where they are provided with a moral compass which does help one to determine the right direction, as well as helping them to determine the correct direction and follow through with a decision to do what is right (Trevino and Nelson, 2011). Trevino and Nelson (2011) state “The principles, norms, and standards of conduct governing and individual or organization” ethics form the basis for determining the correct action, or moral behavior, in a particular situation (p. 17). In order for any group or organization to be a success, whether it is a community, family unit or business they need to set and agree with, ethics and rules of behavior. When anyone shares the same ethical standards builds a harmonious situation for all involved. Among our culture and other cultures there are ethical codes that are alike and are agreed upon. For example within our nation and others dishonesty is frowned upon, steeling, abusing individuals or animals in not tolerated and is believed to be unethical. When you think of what makes a person ethical in your eyes you look...

...Malpractice and Chain of Command When one becomes a nurse, one must realize that there is a great deal of responsibility involved with that title. To be a nurse is being faced with many issues such as legal, moral, or ethical. A nurse must be able to differentiate between them and not let either interfere with their job yet still be protecting themselves from any backlash. I am faced with an issue that involves, I believe, all the issues presented. There is a patient with COPD, chronic obstructive pulmonary disorder, who is having difficult respirations, increased cyanosis, and increased anxiety. She cannot breathe and the nurse has done all the measures for which she has orders for. Still there is no relief. It is 2 in the morning and she calls the provider who orders Valium 10 mg IM now. Even though this is a new graduate nurse she is aware that Valium is contraindicated for this patient because of her respiratory status. After consulting with the nursing supervisor, who tells her that Dr. Jones is a good doctor and must know what he is doing, appears to not know what to do. It is obvious that there are legal issues in medical practice. Patients have legal rights as a person that have to be abided by in any situation. They have the right to life, liberty and freedom. The right to life is upheld by the medical professionals with the treatment that they give to them to either prolong or better their health. They also have the liberty to chose how they want...

...Outline 1. Trust is so important in creating effective ethical leadership 2. The sense of fair treatment within groups of people 3. Marketing, advertising and ethics interplay the idea of subjective and objective evaluation 4. The issue of bribe in proper ethical leadership 5. Summary 1. Trust is so important in creating effective ethical leadership Leaders are the most important and powerful influence on the culture of an organization and are responsible for creating credibility and trust. It is obvious that employees contribute more when they are working for something they believe in. From my observation, I found that if a leader cannot earn the trust and credibility from his team, he might lose his team at the end. Great leaders, like great companies and countries, create meaning, not just money. My industry must satisfy consumers’ expectations. The ends are the very reason for existence of the enterprise. At the same time, the means by which they achieve those ends are increasingly important. When employees have no clear picture of the moral or ethical stance of the organization, they tend to operate at the lowest perceived level. 2. The sense of fair treatment within groups of people Regarding recruitment, good organization should identified two major areas: • Diversification of sourcing to have access to a broader range of profiles • Objectifying the recruitment process to ensure fair selection Diversity is in our DNA and lies at...

...McDonalds Social Responsibility Company X is a global producer of equipment for the food manufacturing industry and has production facilities spread all over the world but concentrated in northern Europe and the United States. Currently Company X has organized its production facilities so that each one is specialized in a type of equipment and that facility produces equipment to ship all over the globe as orders are received. The spare parts for the equipment are stored at either these production facilities or at a central warehouse located in Aarhus, Denmark. There are sales and service units (SSU’s) in approximately 30 countries that are responsible for customers on a local level. Each of these companies keeps a stock of spare parts, out of necessity, but they are encouraged to keep stock levels as low as possible. All spare parts and equipment are ordered either directly from the production facility or from the central warehouse. The central warehousing of parts and equipment allows Company X to keep stock levels low and reduce working capital, thus reducing interest costs. This does, however create a need to ship these parts all over the world, often by airfreight, resulting in transport causing greater emissions than if the companies were allowed to source parts locally or keep more parts on hand and rely on ocean freight. The current distribution method, although beneficial to Company X in terms of working capital reduction and ease of manufacturing scheduling...

...What are Online Term Paper Mills? Online term paper “mills” which sell finished research essays to students are surprisingly rampant. According to turnitin.org, the leading site in automatic plagiarism detection, 29% of students' essays contain "significant plagiarism" and 1% are fully plagiarized. The Kimbel Library at Coastal Carolina University lists over 250 online sites which sell or give away copies of research papers on all subjects. Owners of these websites report daily emails from students profusely thanking them for their "help." Of course cheating and plagiarism have always been problems in academic environments, but with the internet, it is so incredibly easy to simply grab a paper online when the due dates mount up. Defining Plagiarism Plagiarism is defined as copying someone else's words or ideas without giving them due credit. With the use of online term papers on the rise, it is imperative that teachers educate themselves and their students on what constitutes plagiarism and how to avoid it. For a good start, go here. Why Students Plagiarize. Most of us would agree that plagiarizing violates some basic rules of ethics, and furthermore, nobody would dispute the claim that handing in a paper downloaded from the internet (or copying significant portions of it) constitutes plagiarism. So how do students justify these actions to themselves? Well, many claim that the academic environment places an unreasonable emphasis on both "formal" assessment through writing...

Pursuasive Paper

...Persuasive Paper For your second major assignment, you will be writing a persuasive paper. In a persuasive paper, you convince your reader to take your side on an issue by using several influential techniques, including appealing to your reader’s emotions and establishing credibility and authority. A good persuasive essay will sway your reader to agree with your views. For this particular persuasive paper, you will write about an ethical issue of your choice. Some example issues include: * Euthanasia * The use of social media by employers to screen prospective employees * Vaccination * Abortion * Animal rights * Capital punishment You do not have to choose one of these example issues, but for whatever issue you choose, you must take a stance regarding it and convince your reader that your point of view on the issue is correct. Use persuasive techniques like pathos, ethos and logos to sway your reader to your side. Remember that you can use the same topic in this paper for your future argumentative and research papers, but those papers will be discipline-specific – they’ll ask you to write about an argument and topic within your discipline. If you want to write about the same issue for all three of these papers, you’ll want to take a stance on an issue within your discipline for this paper, too. The grade breakdown for this paper is as follows: Assignment | Point Worth | Rough draft | 40 | Peer review | 10 | Final draft | 100 | Total | 150 | ...
