Appellant's Opening Brief to the Colorado Court of Appeal

...that counts, not the fact that a particular litigant may have, in fact, defaulted on a debt. Fuentes vs Shevin, 407 US 81 at 87 Several issues of First Impression arise from the facts in this case for which oral arguments may provide additional basis to allay any concerns that this court may have to determine the merits on appeal. V. SUMMARY OF ARGUMENTS Brumfiel contends that the Trustee, advancing the claim of the Trust, does not have standing because; MERS lacked authority to assign once its agency relationship with First Franklin ended; the MERS PROCEDURES MANUAL states that MERS lacks authority to transfer debt; that the close relationship between the Trustee and the “Trust” requires that the standard to be applied is: “holder in due course”, and the Trustee’s post acquisition of mortgage debt was part of a conspiracy to shore up under collateralized mortgage pools where First Franklin committed a 3 massive fraud on investors. The fraud continued when the Trustee fraudulently acquired notes after the Trust’s closing date. Furthermore, Brumfiel alleges that the CAPP procedure was inapplicable where the lender was acting soley as a debt collector; the plaintiff and its associates’ fraudulent acts show Unclean Hands and Unjust Enrichment; and that the constitutional issues in the federal case over the Rule 120 also affects the Rule 105. In remanding the case for judicial foreclosure Judge Martinez bifurcated the constitutional issues to be determined separately with the......

This study is a part of a larger research programme aiming at building a model of intrapreneurship and testing the model in different kinds of organisations and contexts. In this paper we present results of the survey of 8 companies and 184 employee responses. Based on these preliminary results we discuss the findings and implications for further research. The study points out that the prerequisites and outcomes of intrapreneurship have a positive dependency relation. Higher levels of the prerequisites of intrapreneurship both in quantity and quality, the more outcomes of intrapreneurship are observed. Measuring intrapreneurship sheds light on some aspects of the phenomenon studied, but it also leaves several questions unanswered. Therefore, in order to better understand it and to benefit from phenomenon, it is......

Using average years of schooling as an education measure implicitly assumes that a year of schooling delivers the same increase in knowledge and skills regardless of the education system. This measure also assumes that formal schooling is the primary source of education and that variations in the quality of nonschool factors affecting learning have a negligible effect on education outcomes. This neglect of cross-country differences in the quality of education is the major......

Negotiable Instruments

...IN DUE COURSE I. ACQUIRING HOLDER IN DUE COURSE STATUS If you remember the rule that a holder in due course takes free of most of the defenses the parties to the original transaction have against one another, it is easy to see why it is important to determine if the person currently possessing the instrument qualifies as a holder in due course. The basic definition is found in §3-302(a), which you should read carefully. Official Comment 4 to §3-302 makes it clear that the payee can qualify as a holder in due course in some rare situations. Normally, the payee is so involved in the underlying transaction that he or she has notice of problems affecting payment obligations, and thus cannot be a holder in due course. But the examples given in Official Comment 4 describe fact patterns where the payee is innocent of such knowledge and can therefore qualify for the protection given to holders in due course. See also Eldon’s Super Fresh Stores, Inc. v. Merrill Lynch, Pierce, Fenner & Smith, Inc., 296 Minn. 130, 207 N.W.2d 282, 12 U.C.C. Rep. Serv. 490 (1973), for an example of the payee as a holder in due course. 35 36 3. Holders in Due Course Subsection (c) gives a list of extraordinary transactions — creditors seizing instruments by judicial process, the sale of an inventoried business (a ‘‘bulk transaction’’), or the appointment of the administrator of an estate containing negotiable instruments — in which the transferee is statutorily denied holder in due course......

Honor study is intended to help the person’s spiritual character development. Therefore, every honor should be designed to require high standards of excellence by clearly stating in all requirements what tasks are to be accomplished. Fulfilling the requirements should be interesting and fun, while at the same time providing the person with a sense of achievement. The study of an honor should provide a person with an attractive way to learn about their surroundings or widen their exposure to new horizons of adventures. Such study topics might include learning about hobbies, a special interest, or being introduced to a new vocation. Each honor should be designed to accomodate group study of a club meeting, family, or individual study by a highly motivated person. The entire content of the honor should be capable of being completed in less than three months. Because Pathfinder honors are a part of a church-sponsored program, all facets of course study should be in......

Economic Nexus in Washington State

...that an out-of-state vendor, whose only contacts with the taxing state were by mail or common carrier, lacked nexus with the state.38 The Quill Court acknowledged that “contemporary Commerce Clause jurisprudence might not dictate the same result were the [issues in Bellas Hess] to arise for the first time today . . . .”39 It consequently held, however, that with respect to retail sales tax and use tax collection, a taxpayer must have a physical presence in the state before the state could impose a collection responsibility on the taxpayer.40 It has been argued that the Court chose to support the continuing value of a bright-line physical presence test because of the principles of stare decisis and the substantial reliance of the entire mail order industry on the Bellas Hess holding.41 III. THE NEXUS DEFINING CASES The Supreme Court established the current constitutional framework for assessing nexus issues in the Quill case without distinguishing the U.S. Constitution’s Commerce Clause and Due Process Clause nexus requirements for tax purposes, and without definitively stating to what taxes physical presence applies. However, the Court expressed foundational constitutional nexus principles in several important earlier decisions. In Wisconsin v. J.C. Penney Co., the Court defined the nexus analysis as “whether the taxing power exerted by the state bears fiscal relation to protection, opportunities and benefits given by the state” and stated that “the......
