Using Your Own Knowledge as Well as the Extract Identify and Explain Two Sources of the British Constitution (10)

...(written in one single document) for example in the USA and uncodified (unwritten, no single, formal document) in the UK. One source of the British constitution is statute law, this is law that is written down and codified into law. Statutes begin as bills: there are public and private bills. Public Acts are those that affect either the whole of the UK or some of its constituent countries; England, Scotland, Wales and Northern Ireland, whereas private Acts may grant limited powers to public bodies such as local authorities (councils), or apply only to specific locations within the UK. To begin with, a bill is scrutinised and then refined if needed before the final draft is created. Then it is given its first reading, and after its second reading there is a general debate as to its contents. Once at the ‘Committee stage’ both the House of Commons and the House of Lords may make amendments to it. Then further amendments may be made when it is considered at the report stage. A third reading allows for final changes to be made, and it is passed to the other house (the Lords if it is a Commons bill, and the Commons if it is a Lords bill), and final amendments can be made. Once these processes have been completed, the bill receives the ‘Royal Assent’ (monarch’s signature), after which it becomes law. Although statute law codifies...

...One of the FMLA laws that was revised was it entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons. The FMLA also includes certain military family leave provisions. The Department of Labor issued a Final Rule on February 25, 2015 revising the regulatory definition of spouse under the Family and Medical Leave Act of 1993 (FMLA). The FMLA entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons. The Final Rule amends the regulatory definition of spouse under the FMLA so that eligible employees in legal same-sex marriages will be able to take FMLA leave to care for their spouse or family member, regardless of where they live. This will ensure that the FMLA will give spouses in same-sex marriages the same ability as all spouses to fully exercise their FMLA rights. The effective date for the final rule is March 27, 2015. So what that is saying now is that it does not have to be a man that a woman is married to and the partner of the woman as long as they are married can also have leave. It does not have to be the opposite sex no more. It as well says that it does not have to be the state that you were married in as well. About time it is changes. The Department has moved from a “state of residence” rule to a “place of celebration” rule for the definition of spouse under the FMLA regulations. The Final Rule changes the regulatory......

...Executive, Judicial, and Legislative. The two groups will run into problems when implementing the project or protecting the environment because of the different way each group views of the project. The final view between the groups comes to the conclusions should the government allow the project to produce oil and increase the job rate or should the focus be about the environment and the affects that will come from the company. Both views are equally important but ultimately the government will make a final decision. Reaching a final decision will involve the three branches of government. Branches of Government: Executive branch- “Carries out laws made by Congress” (Melvin, 2011, p. 29). Judicial branch- “Authorized to decide cases and controversies falling within federal jurisdiction.” (Melvin, 2011, p. 29). Legislative branch- Power to regulate commerce, power to tax and spend, power to regulate bankruptcy, patents, and copyrights; and a general implied authority to make all laws necessary for carrying out its enumerated powers. (Melvin, 2011, p. 38). The Legislative branch controls the approval or decline of the pipeline project; the pipeline company will have to design a detailed proposal for the project while making sure it follows environmental and safety regulations before submission to this branch of government. After the project is approved or decline it can carry on to the next branch of government, the Executive. If for chance the proposal is declined......

Aviation Law Module One

...Aviation Law Module One Questions and Answers Describe how a federal agency, like the FAA, creates and enforces regulations being sure to discuss the enabling authority a federal agency derives from federal statutes. When the FAA proposes a new regulation or changes to an existing regulation, they issue a document known as a Notice of Proposed Rule Making (NPRM), Federal law requires virtually all administrative agencies and departments of the government to conduct their rulemaking operations in this manner. The law requires that once the NPRM has been issued there must be a period of time for comment and consideration of the new proposed regulation. After the comment period closes the FAA considers the comments from the public and those affected by the new regulation. Often times, comments from the industry and public have influenced the FAA to either change or abolish the propsed regulation all together. When the process has run its course, the FAA issue’s a Final Notice of Rule Making. This notice will set forth the final rule as it will be adopted and an effective date for it to take effect. Under the Code of Federal Regulations (CFR), Title 14-Aeronautics&Space, Part 13 Investigative and Enforcement Procedures, Subpart B-Administrative actions, the FAA may administer a “Warning Notice” which deals with the available facts and information about the incident or condition and shows that it may have been a violation. The FAA may also give a “Letter of Correction”......
