Baltimore in 1833. The petitioner, John Barron, was seeking a ruling against the city of Baltimore. Barron claimed the city had violated his Fifth Amendment rights. “The Fifth Amendment provides that the government may not take private property without just compensation”. Barron alleged that his wharf was too shallow for most boats to dock because of a road construction project. The city had dumped sand and other solid materials into the wharf impeding the water depth.
