The parties are in court because of an incident that took place on May 222nd 1976, the plaintiff Howard Bettel who was 15 at the time and, six of his friends went inside of the defendant Ki Yam convince store that was located in a plaza at Metropolitan in Toronto. The group of boys were seen entering the establishment at 8pm and was seen playing on the pin ball machine, the defendant explains how the boys were mishandling the merchandise and was asked to leave the store. The plaintiff explains that he and his friends left the store voluntary. The plaintiff and his friends began to throw wooden matches onto the sidewalk which caused them to ignite, the front door of the defendant store was open the door which was on a curved hinge that attached
