...Introduction The focus of the present thesis is the passive voice, perceived from a semantico-syntactic point of view. My primary aim is to explore the use and functions of the passive voice in English, examining the reasons which motivate an author to prefer the passive form to the active one. Secondary interest is devoted to the function and the use of the passive voice in Czech. As research material I have chosen the short stories by the American writer O. Henry and their Czech translations by Stanislav Klíma. The reasons why I have chosen the genre of a short story are that it is noted for the unity of time, place and action. I believe that due to this fact, the results of my research will give higher evidence of the use of the passive voice since the basis for comparison is unified and compact contrary to, for example, a novel. For the same reason of evidence, I explore just the translations of one translator, since everyone has his/her personal style and different way of thinking and understanding of original text. I am interested in the issue of information packaging, especially in the different ways of expressing one and the same reality in the two languages: when both active and passive versions are formally permitted, what factors favour the choice of one over other? ...The short-term memory/long-term memory distinction If there is a difference between short- and long-term memory stores, there are two possible ways in which these stores may differ: in duration, and in capacity. A duration difference means that items in short-term storage decay from this sort of storage as a function of time. A capacity difference means that there is a limit in how many items short-term storage can hold. If there is only a limit in capacity, a number of items smaller than the capacity limit could remain in short-term storage until they are replaced by other items. Both types of limit are controversial. Therefore, in order to assess the usefulness of the short-term storage concept, duration and capacity limits will be assessed in turn. Short-term memory is used to remember a number looked up in a telephone book. Students who cram for a test retain the information in their short-term memory. Important life moments, such as the birth of a child, are stored in a person's long-term memory. Looking through old photos will likely trigger long-term memories. Sachs* The Strong Precautionary Principle, an approach to risk regulation that shifts the burden of proof on safety, can provide a valuable framework for preventing harm to human health and the environment. Cass Sunstein and other scholars, however, have consistently criticized the Principle, rejecting it as paralyzing, inflexible, and extreme. In this reassessment of the Strong Precautionary Principle, I highlight the significant benefits of the Principle for risk decision making, with the aim of rescuing the Principle from its dismissive critics. The Principle sends a clear message that firms must research the health and environmental risks of their products, before harm occurs. It does not call for the elimination of all risk, nor does it ignore tradeoffs, as Sunstein has alleged. Rather, through burden shifting, the Principle legitimately requires risk creators to research and justify the risks they impose on society. By exploring where the Principle already operates successfully in U.S. law—examples often overlooked by the critics—I highlight the Principle’s flexibility and utility in regulatory law. This Article uses chemical regulation as a case study in how the Principle can guide Congress in an ongoing controversy. Congress is considering a major overhaul of the flawed Toxic Substances Control Act of 1976 (TSCA), and this change could be one of the most significant...
