Online Poker and Internet Gambling In this paper I will be discussing the issues of online poker and Gambling. The wire act was implemented in September of 2011 by the Federal Government and this made it illegal to transfer money online for the purpose of gambling. In 2007, the head of the FBI's Cyber Crime Fraud unit, Leslie Bryant, issued a stern warning to Americans: "You can go to Vegas. You can go to Atlantic City. You can go to a racetrack. You can go to those places and gamble legally. But don't do it online. It's against the law." (POKER FACE Business Source Complete). Four years later, the U.S. Department of Justice unsealed indictments against the online poker industry's top three poker sites, Full Tilt Poker, Poker stars, and Absolute Poker. The companies, all located offshore, were hit with a bunch of charges, including wire fraud, bank fraud, money laundering and operating in the U.S. in violation of the Unlawful Internet Gambling Enforcement Act (UIGEA).This was a devastating blow to the poker community and online poker was never the same in the United States. Poker players refer do this say as, “Black Friday.” I believe this is a problem and that Americans should have the right to do with their money as they please. Poker is a game of skill, otherwise there wouldn’t be tournaments and the same people wouldn’t win tournaments and make millions of dollars. It is considered a sport now and is shown on ESPN. Pg 1

Billionaire casino owner Sheldon Adelson says that online poker hurts the brick and mortar casinos revenue and isn’t good for the economy. I believe that he has influence on politicians and this is making it increasingly difficult for online poker to come back. Slowly online poker is coming back state by state, Nevada, New Jersey, and Delaware are leading the United States into the billion dollar a year industry, and many more states are looking to get into the game in the very near future.
Federal law does not say whether poker, a game in which skill is more important than luck, qualifies as gambling, let alone illegal gambling. The U.S. Justice Department argued that online poker was illegal under the Wire Act of 1961, which prohibits using "a wire communication facility" to accept bets "on any sporting event or contest. When the feds starting busting these websites many poker players had their money frozen in the accounts for up to a year. Pokerstars is considered the best poker website, because it averages 10,000 in traffic on a regular basis. As of right now, Poker stars doesn’t accept US players, but has recently entered the market in New Jersey. This leads me to believe that poker will become legal again in the US one state at a time, just like Marijuana. This could lead to another poker boom, which would be simply amazing.
Roughly 80 countries have legalized online gambling including Canada. Federal legislation could provide a way for regulating and taxing foreign operators in order to protect players it would also clear up the grey area with the Wire Act and other federal laws to online gaming. Online casinos like to real in young people by offering them free money or even offer deposit bonuses. There are Websites as of right now that operate and accept US players like Bodog and Americas Card Room. Most banks will not process payments to online gambling websites, but these sites use clever ways to disguise the

Pg 2 transactions. They either use 3ird party vendors or simply creating phony corporations to fool the banks. These sites are considered small and average about 2,000 in traffic on a daily basis. These makes the games tougher and harder to make money on a regular basis. PokerStars hired pricey, big-name lobbyists, including a, former Democratic House majority leader Richard Gephardt and just finalized a deal on August 1 to be acquired known Amaya Gaming Group, based in Pointe-Claire, Quebec, for $4.9 billion. The transaction has created the largest gaming company in the world and wants to make online gambling in the U.S. their top priority. States looking at legalizing online gambling include Illinois, New York, Iowa, Minnesota, Mississippi, Louisiana, California and Massachusetts.
The Poker Players Alliance is an American nonprofit Interest group formed to emphasize the rights of poker players, and to protect the player’s liberties. The PPA formed to serve as an advocacy group to Washington to establish rights and protections for U.S. poker players. Within the first year of its existence, the PPA garnered over 600,000 members. In April 2008, the PPA claimed to have signed up its one millionth member. Membership growth has been due to promotional activities by online poker cardrooms like Party Poker. I am a part of this group and I am hoping that out efforts pay off and eventually lift the ban. Both Democrats and Republicans have received political donations from the gaming industry, including Obama, who received more than $1.7 million in reported donations from the industry, according to the Center for Responsive Politics. Internet gambling is much better if we want to be in the safe side. There are lots of gambling games available that we can play on websites, as well as download them, to play at our own convenient time. There are games involving money and also games that that involve no money transactions. The New Jersey legislature voted in near unanimity to revive

the state’s gaming economy by making New Jersey the center for online gaming and poker. Since the legislation was sent to Governor Christie’s desk, the public has been unanimous in its support for the bill. “Thousands of New Jersey residents have contacted the Governor urging him to sign the bill into law”, said John Pappas, executive director of the PPA. In addition to providing New Jersey poker players with a safe and regulated online poker market, this important legislation will add millions in state revenue and thousands of jobs to the state. Through PPA’s new webpage, New Jersey residents can contact Governor Christie via phone, email, Facebook and Twitter to try and get him to sign the bill into law. Since the campaign was launched last week, New Jersey voters have made more than 500 calls to the Governor, sent over 1,300 emails and flooded the Governor’s social networks with Tweets and Facebook posts trying to get him to sign the bill. Hopefully he will before time runs out.
It is every poker players dream to play in and win a bracelet, which is the most coveted prize in poker. Of course millions of dollars are won along with the bracelet. This tournament is call the (WSOP) or World Series of poker. The buy in for this prestigious tournament is $10,000, which is way above my bankroll, but I feel that in time I will be able to enter this tournament. You can play satellites online and win tickets to these huge tournaments for a fractions of the cost. I am an avid poker player, or grinder and I have been playing off and on for over 2 years. I’ve studied the game on a deep level and watched countless hours of training videos and have read many books. I don’t quite consider myself a professional yet, but I am a regular winning player. There is math in poker and you can use this math in a form of odds to help you made your decisions. If you combine the math, hand reading, and the ability to label players at the tables, you will have an edge over other players. You have to think of poker as one long session and track your win rate on a broad scale. Sometimes there are downswings and you Pg 4 can be playing sound poker, but will still lose money, because that’s just the way the cards fall sometimes. This is hard to accept and can make poker and emotional and stressful game. Even a bad player can win in the short run, but eventually his lack of skill will cause him to lose in the long run.
Sometimes when losing you will become frustrated and make more bad decisions and lose you whole stack. This is what poker players refer to as going on tilt. You have to be able to recognize these signs early on and either take a break to clear you head, or just stop playing. I feel think that it is absurd that we live in a free country and the government can tell us what to do with our money. Why is it that in some states gambling is legal and others you can go to jail for it? It just doesn’t make sense to me. Some religious fanatics may say that gambling is a sin. Well my rebuttal to that is even when Jesus died, his disciples cast lots for his belongings. I do understand that some people do have gambling addictions that can affect their lives in a negative way. I think that the government is worried about underage kids being able to gamble online since there isn’t a solid way prove that you are of age. Maybe if the government made it mandatory for American’s to send the sites a copy their ID before playing would solve this issue? To sum it up, we may say that the reason as to why the civilized mass have chosen gambling as their favorite pastime is that it is fun. Houston is losing a ton of money to Louisiana, because all of our Houstonians, including senior citizens, are taking charter buses and spending their money there. Poker players don’t particularly like to be called gamblers, but we sure would like to be able to play some poker legally. Houston does have a huge underground poker scene, but it sucks that it has to be hidden from the law and it’s always in the back of our minds that the police could come storming in and bust us at any given moment. For me, poker is freedom and my passion. When I’m playing poker I’m in a pure state of happiness and I love the game. Im a optimistic that congress will eventually lift the ban and Poker and online gambling will make its inevitable come back.
