The interview by Professor Zalman and Carl Marlinga and is about Jeffrey Moldowan’s exoneration. Carl Marlinga has extensive experience working with wrongful convictions; he is a former prosecutor and probate judge. Jeffrey was accused and convicted of brutally assaulting and raping a young woman in 1989. This particular young lady was walking around at night by herself coming from a night of drinking. She was on 11 Mile and Van Dyke walking alone in the dead of night. Four men grabbed her and started to beat and rape her. After the horrendous act, she was left on the street to die and luckily someone found her and took her to the hospital. There were issues with the victim being intoxicated and how this could have hindered her ability to identify the assailant. Plus there was little scientific evidence because there was just a bite mark. A forensic odontologist made the claim that he would be able to identify the attacker based solely on a bite mark. This forensic odontologist stated that Jeffery is linked to the bite mark. The scientific evidence turned out to be junk science and did not prove that Jeffery was indeed guilty. Marlinga wrote a post-conviction motion to the Supreme Court. The Supreme Court granted the right to a new trial. Additionally, the proposal brought up some questions which caused Judge Malinga to be judged by his peers, and this ultimately leads to Marlinga being wrongfully convicted based on Carl allowing his campaign contribution change his judgment. As a result, he had to go to trial and was found not guilty. This lead Carl to understand how it feels to be wrongfully convicted.
