Ang nasasakdal, ay gumagalang na isumiti sa Hukumang ito ang Pang-hukumang Sinumpaang Salaysay ni ISAGANI MENDEZ, sa pamamagitan ng pagtanong ni Atty. Philip N. Humilde at pagsagot ni Billy Mendez na naganap sa opisina ng naturang abogado sa Sadsaran, Poblacion, Alaminos City, Pangasinan, para sa mga sumusunod na purpose: 1. Para sa kanyang testimonya na kaugnay ng kasong ito, 2. Para ilahad ang tunay na pangyayari na naganap noong Disyembre 27, 2012, 3. Para patunayan na wala siyang kasalanan at hindi niya sinaktan si Romeo Calpo, at 4. Para patunayan ang iba pang mahahalagang allegasiyon sa kasong ito.

PAGKATAPOS MANUMPA, ayon sa batas, ito ang masasabi ng testigo:

1. T.Para sa record, maari mo bang sabihin ang iyong pangalan, tirahan, edad, estado at trabaho. S. Ako po si ISAGANI MENDEZ, nasa wastong edad, walang trabaho, at kasalukuyang nakatira sa Barangay Mona, Alaminos City, Pangasinan.

2. T. Sa pagsagot ng mga tanong na itatanung ko sayo, alam mo ba na ikaw sumusumpa na naayon sa batas na pawang katotohanan lamang ang iyong sasabihin at kung ikaw ay magsinungaling ikaw ay maaring sampahan ng kaukulang kaso ng pagsisinungaling sa iyong testimonya o perjury? S. Opo sir.

3. T. Ikaw din ba si Isagani Mendez isa sa inihabla ni Romeo Calpo sa hukumang ito sa kasong pananakit?
S. Opo sir.

4. T. Kakilala mo ba si Romeo Calpo? S. Opo sir, siya po ay aking pinsan.

5. T. Naalala mo ba kung nasaan ko noong araw ng Disyembre 27, 2012, ang araw na animoy naganap ang isang insidente?
S. Opo sir, ako po ay nasa Bahay ni Brgy. Kgd. Roberto Domalanta sapagkat nagluto po kami dahil kasal po ng anak ni Kgd. Domalanta.

6. T. Nakita mo ba doon si Romeo Calpo? S. Opo sir.

7. T. Ano ang kanyang ginagawa duon sa bahay ni Kgd. Domalanta?
S. Dumating po siya na lasing sa bahay ni Kgd. Domalanta nuong pagkatapos naming magluto at kami nuon ay nag iinuman at humihiram siya kay Kgd. Domalanta ng “Selyasi” na ginamit naming sa aming pagluto..

8. T. Ano ang sumunod na nangyari kung mayroon man? S. Dahil siya po ay aking pinsan inaya po naming siyang umupo muna at sumali sa aming inuman at siya naman po ay umoo at kami po ay nag inuman.

9. T. Habang kayo ay nag iinuman, ano ang sumunod na pangyayari kung mayroon man? S. Habang kami ay nag iinuman, laking gulat ko na lang po ng biglang tumayo si Romeo Calpo at bigla niyang sinuntok si Billy Mendez sa kanyang mukha sabay tumakbo po siya papalayo sa aming pinag iinuman.

10. T. Ano ang mga sumunod na nangyari kung meron man? S. Nabigla po ako sa ginawa ni Romeo Calpo at ng makita ko na papalayo siya hinabol siya ni Billy Mendez at agad naman po akong sumunod sa kanya, at ng malapit na po kami kay Romeo Calpo ay nakita ko pong siya ay natalisod at nadapa nauna ang kanyang mukha na tumama sa mga bato na naging sanhi ng kanyang bukol at sugat sa mukha, at dahil sa siya ay lasing hindi siya agad nakabangon at kami naman ni Isagani ay tumigil na sa paghabol sa kanya at bumalik na kami sa bahay ni Kgd. Domalanta.

11. T. Noong kayo ay nag iinuman at dumating si Romeo Calpo sino ang kanyang kasama? S. Wala po, siya ay mag isang dumating.

12. T. May gusto ka pa bang idagdag sa iyong salaysay ? S. Wala na po.

The main remedy is damages, but in certain situations, equitable remedies are available. 1. Unliquidated Damages Unliquidated damages are assessed by the court and are designed to compensate the innocent party for any losses incurred as a result of a breach of contract.
