Introduction Greene’s Jewelry Wholesale, LLC (Greene) seeks remedy from previous employee, Jennifer Lawson (Lawson), regarding Lawson's breach of a confidentiality agreement between Lawson and Greene to not disclose trade secrets of Greene's primary asset, Ever-Gold. Lawson, a previous employee of Greene, was terminated after Greene downsized its company. Greene also denies Lawson was wrongfully terminated as she claims in her counter suit. Upon termination, Lawson improperly shared trade secrets from Greene and used them for personal benefit by providing direct competitor, Howell Jewelry World (Howell), with the information in exchange for employment. Upon discovery of Howell's modified version of Ever-Gold and that Lawson had given confidential information to Howell, Greene filed a suit against Lawson for breach of the confidentiality agreement.
1. Lawson's Termination The day of Lawson's termination, she met with Greene's head of human resources, Lisa Peele (Peele). Lawson advised Peele that she may need additional time off due to complications with her pregnancy. Unfortunately, Peele delivered less desirable news to Lawson stating her position had been eliminated due to the company downsizing. Peele's exact words were, "Congratulations, Jennifer! That is exciting news for you. We do not need to worry about time off, though, because, regrettably, I was just going to let you know that we are downsizing and no longer have a need for any of our junior executive secretaries."
