Introduction
PharmaCARE is a very successful pharmaceutical company; based in New Jersey. It is known for having a caring reputation, and being an ethical and well-run company that produces life-saving; high-quality products. The company is known for caring because the business offers free and discounted drugs to low-income consumers, has a foundation that sponsors healthcare educational programs and scholarships, and its CEO serves on the PhRMA board. Recently, PharmaCARE launched a new initiative; We CARE about YOUR world®. This action pledged its commitment to the environment through recycling, packaging changes, and other green initiatives. However, the company’s lobbying efforts and Political Action Committee (PAC) have successfully defeated environmental laws and regulations. They now maintain a large manufacturing facility in the African nation of Colberia.
In Colberia, the company benefits from the free information on alternative methods of healing. PharmaCare repays the natives by offering the Colberians jobs that pay $1 a day. The duties consist of harvesting plants by walking five miles into and out of the jungle carrying baskets that can weigh up to fifty pounds. After working a long hard day for $1, these same workers return to their primitive huts with no electricity or running water. Being poor is the way of life for most of the population of Colberia; however PharmaCARE’s executives are Americans. They live in a luxury compound, complete with a swimming pool, a tennis court, and a golf course. They live the American lifestyle in a third world country while the extensive activities destroy the habitat and endanger the native species. PharmaCare seems to have

Author: Brooks, Rochelle. .. Publication info: American Journal of Business Education 3. 10 (Oct 2010): 1-13. .. ProQuest document link .. Abstract: In today's organizations, ethical challenges relate to areas like fraud, right to privacy for consumers, social responsibility, and trade restrictions. For Information Technology (IT) specifically, these can translate to considerations on how technology is used to violate people's privacy, how automation leads to job reductions, or how management information and its corresponding systems are used and abused for personal gain. In the last 25 years, people have seen an overwhelming technology infusion affecting business, education, and society. Virtually all areas of the society have been transformed by the usage of technology. The change is important from an ethical perspective in terms of who Information Technology (IT) workers are today and what their tasks are. Higher education, specifically in business schools, needs to take some responsibility in preparing students for...

Legal and Ethical Considerations in Marketing, Product Safety, and Intellectual Property

...Legal and Ethical Considerations in Marketing, Product Safety, and Intellectual Property Wanda T. Diggs Professor William Stone Law, Ethics and Corporate Governance – LEG-500 March 18, 2014 Abstract The PharmaCARE scenario is a case study based on a real life tragedy. Corporate corruption is alive and well and, as this case proves, unethical corporations will break the law for extra profit. Utilitarian ethics should be considered when in the business of providing consumable products to the public. Unfortunately, there are pharmaceutical corporations operating in the U.S. who are not abiding by the law and who are endangering public safety. Introduction This case study involves a pharmaceutical company that violated the intellectual property rights of a foreign nation; violated state compounding regulations, and violated product safety laws. The company established a compounding pharmacy to mass-produce a new drug formulation that executives believed would earn huge profits. The most disturbing aspect of this case is that there was a tremendous loss of life as a result of the company’s decisions. The federal government has granted authority to the Food and Drug Administration (FDA) to ensure drugs are safe for human consumption. Today, the FDA faces obstacles relating to lack of oversight control, funding, and human resources needed to provide adequate oversight over compounding pharmacies. This paper covers a broad-brush of ethical and legal issues relating...
