Dear Ms. Starz:
I am writing in regards to our client, Leonardo deCap, who has expressed interest in entering into a contract with Ms. Clair Dawn of Beverly Hills, CA ., regarding a 1965 Corvette Stingray for the price of $26,000.00. The agreement has been outlined in a letter from Ms. Dawn, dated February 13, 2013. [Please refer to the attached photocopy of Ms. Dawn’s letter to Mr. deCap]. Approximately a week later, on February 20, 2013, Mr. deCap responded with his acceptance letter. [Refer to photocopy of Mr. deCap’s acceptance letter].
Upon investigation of both the offer and acceptance letters, I have determined that the offer is valid because it is followed by the unconditional acceptance of Mr. DeCap. (Spagnola, 2006. Pg 2). The contract has been accepted the moment Mr. deCap mailed his letter of acceptance, which complies with the Mailbox Rule as an valid acceptance has been put in writing and mailed with proper postage via the United States Postal Service. (Spagnola, 2006. Pg 42). Moreover, the contract has sufficient consideration for a valid contract due to the recognizable legal value of the exchange between the two parties. In this case, the Corvette for $26,000.00. (Spagnola, 2006. Pg 25). My only concerns are that Mr. deCap did not sign or date the acceptance letter and did not clarify what it is that he is accepting. This may promote issues should Ms. Dawn choose to claim she was unaware what Mr. deCap was referring to with his letter.
Much Regards,

Legal Contract Memo

...Memorandum to Ms. Starz To: Ms. Starz From Date: November 16, 2013 Subject: Legal Contract between Claire Dawn and Leonardo deCapo I have found that there is in fact a legal binding contract between Claire Dawn as the Offeror and Leonardo deCapo as the Offeree (Spagnola,nd). On February 13, 2008 Claire Dawn presented a written offer to sell her 1965 Corvette Stingray to Leonardo deCapo for $25,995.00 plus the cost of the title transfer. The Mutuality of Obligation, or the requirement of both parties to be bound by the terms of the agreement (U.S.Legal,nd), is clearly stated through the offer to exchange the car for the desired amount of payment. When Mr. deCapo makes the payment in full and pays the cost required to transfer the title he will gain possession of the vehicle. There is Sufficiency of Consideration. Both parties are offering something of value, and all of the necessary components are present to make this a legal binding agreement (Clearpoint,nd.). The Parties are clearly distinguished, Claire Dawn and Leonardo deCapo, there is a mandatory value ascribe by the parties to the exchange involved in this contract ($25,995.00 in exchange for the 1965 Corvette), the subject matter is clear and present ( the vehicle/the payment). There Is Adequate Consideration – This is a fair and reasonable offer as the value of the car is consistent with the asking price. The exultancy of the asking price to the value of the car deems this contract valid (Business...

Business Management

...Fiscal Year 2011 Annual Financial Report And Shareholder Letter January 2012 Dear Shareholders, Fiscal 2011 was a year of great accomplishment for The Walt Disney Company, marked by creativity and innovation across our businesses globally, record financial results and numerous important steps to position the Company for the future. While 2011 brought us so much to cheer about, it was also marked by profound loss, with the passing of Steve Jobs. Steve’s incredible stewardship of Pixar, and his decision to sell Pixar to Disney in 2006, brought Steve into the Disney family, as a board member, a shareholder, a mentor, and a friend, and we were so lucky for all that he represented and all that he contributed. Disney, ESPN, ABC, Pixar, and Marvel are an amazing collection of brands that grow stronger every day as new platforms and new markets provide enormous new opportunities for high quality content and experiences. To that end, we are fortunate to have a talented group of employees who are committed day in and day out to building our brands around the world. Since becoming President and CEO in 2005, I have focused on three strategic priorities: creating high-quality family content, making experiences more memorable and accessible through innovative technology, and growing internationally. In fiscal 2011, net income attributable to Disney was a record $4.8 billion, an increase of 21% over last year, and revenue was a record $40.9 billion, up 7% from last year. Diluted earnings...

Manager

...Learning with Cases INTRODUCTION The case study method of teaching used in management education is quite different from most of the methods of teaching used at the school and undergraduate course levels. Unlike traditional lecture-based teaching where student participation in the classroom is minimal, the case method is an active learning method, which requires participation and involvement from the student in the classroom. For students who have been exposed only to the traditional teaching methods, this calls for a major change in their approach to learning. This introduction is intended to provide students with some basic information about the case method, and guidelines about what they must do to gain the maximum benefit from the method. We begin by taking a brief look at what case studies are, and how they are used in the classroom. Then we discuss what the student needs to do to prepare for a class, and what she can expect during the case discussion. We also explain how student performance is evaluated in a case study based course. Finally, we describe the benefits a student of management can expect to gain through the use of the case method. WHAT IS A CASE STUDY? There is no universally accepted definition for a case study, and the case method means different things to different people. Consequently, all case studies are not structured similarly, and variations abound in terms of style, structure and approach. Case material ranges from small caselets (a few paragraphs...
