Environmental issues and regulations In addition to the previously discussed concerns, Big Rapids must identify the environmental issues and regulations related to each site. These environmental considerations, such as their effects on air, water, and land, will have an impact on the final decision where Big Rapids will be located. Regardless of the chosen site, the laws instituted by the EPA must be followed. The following states environmental regulations will be discussed: Arizona, Texas, and Tennessee. Environmental regulations for the state of Arizona are enforced by the Arizona Department of Environmental Quality. Arizona’s environmental regulations primarily focus on air, water, and waste. The Grand Canyon National Park is protected by the Clean Air and Clean Water Acts – these provide for monitoring of hazardous air and water pollutants because of its historical significance. According to the Glen Canyon Institute (2010, para. 6), Congress passed the Grand Canyon Protection Act to protect the Canyon and mitigate damages associated with building new structures within it. Big Ben National Park, located on the Rio Grande River in Texas, is another potential site for Big Rapids. The Texas Environmental Protection Agency is responsible for the regulation of air and water pollution as well as waste reduction. Environmental regulations for the state of California are enforced by the California Environmental Protection Agency. The Cal/EPA enforces the state’s environmental protection laws that ensure clean air, clean water, clean soil, safe pesticides and waste recycling and reduction. If the rafting company wanted to open a location along the Merced River then the California Environmental Quality Act (CEQA) requires that an environmental report be prepared for any major project, which states the pros and cons of the project. Businesses are responsible for the effect their operations will have on water quality. The National Pollution Discharge Elimination System (NPDES) requires permits for anyone who intends to emit any pollutant into state surface waters, including noncontact cooling water and air-conditions or heat-pump water. Laws related to air pollution are controlled by the California Air Resources Board (CARB). The river-rafting business will need a permit because the patrons who want to use the river-rafting services will have to drive to the location. Indirect sources include roads and the emissions of heavy traffic drawn to certain business locations. The rafting company will have to comply will all applicable air pollution controls and they will have to consider the regulations on hazardous waste. California law affects firms storing less than 220 pounds or 27 gallons of waste on-site. The Federal Resource Conservation and Recovery Act require that the waste be disposed of within 90 days once the threshold has been exceeded.
The New York State Department of Environmental Conservation protects New York’s natural resources and environment. The Hudson River is protected by Hudson River Estuary Program and the Department of Environmental Conservation (DEC).
