Facts- On February 3, 1986 two men committed an armed robbery of a pizza place in Maryland. One of the robbers was seen wearing a red track suit. Later that day Prince George’s County police obtained an arrest warrant for suspect Jerome Edward Buie. A couple days later on February 5th the police executed the arrest warrant for Buie. Buie emerged from his basement and was then arrested, searched, and hand cuffed. Afterward a police officer entered the basement to ensure no one else was down there. While the officer was down in the basement he found the red track suit out in plain view linking Buie to the robbery. Buie was then found guilty of robbery.
Issue- Is probable cause that danger exists required
