The DDS proposed a medical vocational allowance determination. The evidence in file does not support the severity assessed by the DDS.
CASE DISCUSSION & POLICY ANALYSIS (INCLUDING SPECIFIC REFERENCES)
This 56- year old claimant is filing a concurrent claim alleging disability due to lumbar degenerative disk disease, lumbar radiculopathy, sciatica, sleep apnea and multiple other medical impairments.
The evidence in file shows the claimant has a history of depression. She was seen 7/13/17. At the exam, she appeared appropriate, her attitude was cooperative and her affect was sad. Her memory, judgment and insight were intact. At the exam on 2/12/17, she was alert and oriented to three spheres. At the consultative exam on 8/8/16, she was cooperative and her motor behavior was lethargic. She had appropriate eye contact. Her speech was fluent & clear. Her thought processes were coherent and goal directed. Her affect was depressed. She reported her mood as depressed. Her attention, concentration and memory skills were intact. Her intellectual functioning appeared to be in the …show more content…
The evidence in file supports the physical determination, however a review of the file indicated this MRFC is too restrictive. DI 24510.006.C.5 indicates the MRFC must be based on all of the available medical evidence, including medical history, medical signs and laboratory findings and effects of symptoms including pain that are reasonably attributed to a medically determinable impairment. In this case, the claimant has no difficulty remembering medication or appointments. She reads, watches TV, has family visits, and gets along with everyone. Most limitations seems related to physical and little or none directly to a mental impairment. There were minimal symptoms present at the consultative exam. State of Andhra Pradesh. [1] An eleven judge bench of the Supreme Court for the first time, inter alia addressed the issue of fee structure in detail in the case of T.M.A. Pai Foundation & Ors. Vs. State of Karnataka & Ors. [2] (hereinafter referred to as the Pai Foundation case). A bench of eleven judges was constituted so that it would not be bound by any of their earlier decisions. The fact that merits consideration is that the apex court was divided in its opinion in this case, which gave rise to subsequent questions, arising from the different interpretations by the different High courts. The apex court was vigilant enough to take into cognizance the ambiguities which had arisen from the aforesaid judgment, hence it constituted a constitution bench comprising of five judges to clarify the doubts which had arisen in the Pai foundation case. The Pai foundation case was elaborated and simplified in the case of Islamic Academy of Education and Anr. Vs. State of Karnataka and Ors.[3] Despite the sincere efforts made by the Supreme Court to clarify the doubts and to answer the questions which had arose subsequent to the Pai Foundation case, the Islamic Academy case had its own lacuna and failed to serve the said purpose.
