Thank you for instructing this firm in respect of the above matter. We can confirm that we will be happy to act for you in investigating the accident for which you seek compensation. At AK Solicitors we will do our best to ensure that everything proceeds as smoothly and efficiently as possible. Your case will be dealt with by Taymour Akhtar who is a senior fee earner of this firm. His supervisor is Tamina Akram who is a qualified Solicitor and she will have the overall responsibility of your claim.

From the information you have supplied it would appear that you have reasonable prospects of success in pursuing your claim and recovering compensation. Our role in acting for you is to carry out further investigations and to value your claim with view to ultimately obtaining compensation for you. Our professional practice rules dictate that we must inform you of a number of matters concerning this claim and how we intend to deal with it on your behalf. We appreciate that this letter is a lengthy document but it is important that you read it thoroughly.

Level of Service & Complaints

It is anticipated that your claim will be concluded within 6 months providing that liability is admitted and subject to your satisfactory recovery but we shall keep you fully advised as to the progress of your claim.

Our aim is to offer all our clients an efficient and effective service at all times. We hope that you will be pleased with the work we do for you and the result that we achieve. However, should there be any aspect of our service with which you are unhappy, this includes if you are dissatisfied with a bill you receive from our firm, please raise your concern in the first place with me and I will discuss this with you. If you are still unhappy then your complaint will be referred to Ms Tamina Akram, the Complaints Partner, for her to investigate fully and to report to you. If the complaint relates to Ms Tamina Akram, please refer it to Mrs Yasmin Kauser for further consideration.

If you still remain dissatisfied, you are entitled to refer the matter to the Legal Ombudsman and/or by applying to the court for an assessment under Part III of the Solicitors Act 1974. If all or part of the bill remains unpaid, our firm may be entitled to charge interest.

Proof of identity

We enclose medical consent form for you to sign and return. We would advise you that medical examinations will not be arranged until liability has been admitted or after a three month period has lapsed.

In order for us to comply with strict money laundering regulations, you must provide me with proof of your identity and your address. Please find enclosed a list of forms of identity and proof of address which are acceptable. We require one PHOTOCOPY of the document from list A and one from list B.

• Current signed Passport, • European Economic Area (“EEA”) member state identity card, • Residence permit issued by the Home Office to EEA nationals on sight of own country passport, • Current UK or EEA photo-card driving licence, • Benefit book or original notification letter from the Benefits Agency confirming rights to the benefits, • National Identity Card containing a photograph

List B

• Recent gas, electricity, council tax or water services bill (not less than 3 months old). • Recent mortgage statement • Rent book or tenancy agreement • Bank/Building Society statement or passbook • Solicitor’s letters confirming recent house purchase.

Referrals

In accordance with the introduction and referal code we are obliged to inform you that as part of the business arrangement with the company which refered your case, we will pay a referal fee. We pay this fee to them instead of advertising and marketing ourselves. Your compensation will be 100% and this fee does not affect your claim and will not be deducted from your compensation.

Where you have entered into an agreement with the introducer that you will pay to the introducer a handling fee at the conclusion of the claim, this sum will be paybale by you whether or not the claim is sucessful. We will in accordance with the written instructions that you have provided either pay full compnesation to the introducer or deduct the handling fee from your award of the compensation.

Conditional Fee Agreement and Funding Options

Our firm will be acting for you under the enclosed Conditional Fee Agreement (essentially a no Win, No Fee agreement) so that if your claim is unsuccessful, you will NOT be liable for the firm’s costs.
In accordance with our obligation as solicitors, we enclose the following:

When returning the enclosed documentation would you please confirm what your exact losses are i.e. loss of earnings, travel expenses, prescription charges etc. In so far as possible please provide documentary evidence in support of your losses. If you have loss of earnings then please provide 13 weeks pre-accident wage slips or the name and address of your employers to enable us to obtain the necessary details from them. This is so that we can work out what your net earnings were before the accident and, therefore exactly how much was lost as a result of the accident. Questionnaires regarding special damages will be sent to you in due course but in the meantime please forward to us any receipts that you may have in your possession relating to the expenses that you would like to recover.

Although we believe your claim is likely to succeed, we strongly recommend that you insure against the risk of having to pay you opponents costs and disbursements. We will take the insurance out for you on your behalf.

We recommend that the necessary policy be obtained from Elite Insurance Limited or Lamp Insurance. We have set the reasons for that recommendation in the attached document headed “Your insurance Requirements” and the attached leaflet will explain the policy. We may also from time to time recommend an insurance policy form other providers depending upon the circumstances of your case.

In the event that it may appear that my initial estimate to you may be exceeded then I will notify you of these charges and in any event I will give you an estimate of your costs at least every 6 months.

We would advise you that if you do become responsible for payment of any of our fees and or disbursements then you have the right to apply for an assessment of the costs and disbursements.

Limitation

Legal Proceedings must be commenced within 3 years of the date of the accident or 3 years from the date of your knowledge of your injuries. In the case of accidents in childhood, legal proceedings must be commenced before the minor’s 21st birthday.

Authorisation

We are not authorised by the Financial Services Authority. However, we are included on the register maintained by the Financial Services Authority so that we can carry on insurance mediation activity, which is broadly the advising on, selling and administration of insurance contracts. This part of our business, including arrangements for complaints or redress if something goes wrong, is regulated by the Solicitors Regulation Authority. The register can be accessed via the Financial Services Authority website at www.fsa.gov.uk/register.

The Law Society is a designated professional body for the purpose of the Financial Services and Markets Act 2000 but responsibility for regulation and complaints handling has been separated from the Law Society’s representative functions. The Solicitor’s Regulation Authority is the independent regulatory body of the Law Society and the legal Complaints Service is the independent complaints handling body of the Law Society.

You may wish to talk to us about this letter, the Conditional Fee Agreement or the insurance that we propose. If so, please feel free to telephone the head of our Personal Injury Department.
