The Morality of Downloading Copyrighted Entertainment

With the expansion of the Internet in the past twenty years, information has become less exclusive to the general population; previously inaccessible information was now fingertips away. It resulted in benefit for a society as a whole, until people whose profession depended on the information being exclusive, now had it being distributed for free. The professions primarily affected were actors, artists, and authors. They all shared a thing in common: copyrighted material. The act of downloading or sharing copyrighted material has been deemed illegal by the United States, yet most people obtain copyrighted material through this manner. This paper focuses on the morality of illegal downloading through the various utilitarians’ perspectives. The findings of the paper will show that the act utilitarians would find illegal downloading to be morally right, while rule utilitarians would find it morally wrong.

Utilitarian theory states that, “an act is morally right only if the act’s consequences do not produce an amount of wellbeing or pleasure worse than the consequences of every alternative act.” The aforementioned consequences are not only intended for the individual who takes the action, but also everyone possibly affected directly or indirectly by them. However, the theory has been further broken down into specificities, two of them being act utilitarianism and rule utilitarianism.

Act utilitarians believe regardless of the act, as long as the act ensures the best overall consequences, that specific act is permissible and makes for it to be morally right. Therefore, the specific act in one instance could be morally acceptable and right, while it could be morally unacceptable and wrong in a completely different situation. Participation in file sharing has also grown. Over 60 million Americans above the age of twelve have downloaded music (Ipsos-Reid, 2002b). File sharing is heavily linked to youth. While a majority of Americans under 18 years old have downloaded and half of those are heavy users, only a fifth of those aged 35-44 have downloaded files (Edison Media Research, 2003). Among U.S. adults at least 18 years old, the number of downloaders has about doubled since 2000 (Pew Internet Project, 2000 and 2003). Because physical distance is largely irrelevant in file sharing, individuals from virtually every country in the world participate. When peers download, they don't all download from one place. Millions of peers around the world are connected and they download files off of each other's computer.  Popular networks are Kazaa, WinMX, Limewire, Morpheus, Frostwire and many more. ...Modern technology has made wide-scale trading of music possible in the form of MP3 files available over the internet for free. Users can simply upload the files to these sharing sites and millions of others at any given time have the ability to download it from them. The Recording Industry Association of America, however, doesn’t share the enthusiasm about these file sharing practices. To them, it is stealing from the record company and from the artist themselves. Consumers don’t tend to see it that way. As did much of copyright law, fair use originated as a judicially unacknowledged effort via the law to validate certain favored practicesand patterns.In the main, it has continued to be applied as such, though too often courts mask their implicit validation of these patterns in the now-conventional "caseby-case" application of the statutoryfair use "factors"to the defendant's use of the copyrighted work in question.
