New Corp Legal Scenarios Law/531

New Corp Legal Scenarios Pat moved 300 miles to Vermont to relocate for employment. He moved his family and bought a new house. Pat signed an at will employment form acknowledging the company can terminate his employment at any time. Pat received a copy of a company employee manual that is distributed out to all new employees. In the manual it states that an employee who is not performing up to standards will be notified of the deficiencies to take corrective action. If the action is not corrected the next step taken is termination of employment. Without any notice or warning the company informed Pat that things were not working out, and they were letting him go, and giving him a 30- day severance pay. Pat felt that he was wrongfully terminated because of an unpopular view he had at a school board meeting. After the school board meeting, he noticed that senior management was unfriendly toward him and Pat believed this may be the reason he was let go. Although Pat signed an at will statement acknowledging he can be terminated at any time , the personnel manual also states that an employee will be noticed of any deficiency before termination. Pat can argue that the company wrongfully terminated him by breach of contract. In Title VII of the Civil Rights Act of 1964 employers are expressly prohibited from retaliating against an employee for filing a charge of discrimination or participating in discrimination proceedings regarding race, color, national origin, sex, or religious discrimination (Cheeseman, 2010). A court can award punitive damages against an employer in a case involving an employer’s reckless or malice actions in order to protect rights (Cheeseman, 2010). This means that Pat may be able to sue the company for breach in contract because

News Corp has operations in eight industry segments which are filmed entertainment, television, cable network programming, direct broadcast satellite television, integrated marketing services, newspapers and information services, book publishing, and other assets (News Corporation 2009). News Corp’s competitive strategy in creating economic value lies in its ability to acquire new media assets through the steady revenue generated by its already well-established newspaper, television, and movie industries. Murdoch created News Corp in 1979 as a holding company for News Limited, which was Murdoch’s original business interest in Australia before becoming part of News Corp during the growth of his media empire. News Corp’s growth and success can be analyzed using the Balanced Scorecard’s four perspectives; financial, customer, internal processes, and learning and growth. Because News Corp is a publically traded company, its main goal is to increase the company’s profitability to provide shareholders with greater returns. According to News Corp’s 2009 annual report, revenues were down for the year. Murdoch addresses these losses in a letter at the beginning of the report reassuring shareholders that the recession...

Characteristics an Environments of a Human Service Organization

...Characteristics and Environments of a Human Service Organization The Peace Corps is a federally funded national organization that helps people in mostly third world countries with education, health, nutrition, youth development, and agricultural needs by means of volunteers (“Peace Corps”, 2012). The following will go into detail about this organizations vision, how it is staffed, who the stakeholders are, public relations, diversity, and environmental trends of the Peace Corps. Vision and Mission The vision and mission statement of the Peace Corps is very clear and simple. According to “Peace Corps” (2008), “The Peace Corps' mission has three simple goals: 1. Helping the people of interested countries in meeting their need for trained men and women. 2. Helping promote a better understanding of Americans on the part of the peoples served. 3. Helping promote a better understanding of other peoples on the part of Americans” (About Us). Governed and Staffed The Peace Corps is a national organization that is governed and staffed by people who are dedicated leaders. The leadership involves not only a director and deputy director, but also is staffed globally by three different individuals which are regional directors in Africa, Asia, and Inter-America and the Pacific (“Peace Corps”, 2010). Battle of the 73rd Easting

...Easting Headed due east on the afternoon of February 26, 1991, VII Corps was advancing with a front of four armored/mechanized divisions. In the center of this front, leading the way and conducting reconnaissance for the corps, was the 2nd Armored Cavalry Regiment (ACR). The 2nd ACR’s job was to locate the forward elements of the IRG divisions suspected to be in the area, fix them in place, then pass the heavy divisions of VIII Corps through their lines so that they could smash the elite Iraqi units with a single killing blow. It was a difficult assignment, made more so by the weather conditions. The winter of 1990/91 was one of the wettest on record in the Persian Gulf, and had been a major problem during the preceding six weeks of the Desert Storm air campaign. Now the wind was howling, causing a sandstorm that was grounding the Army’s aviation assets and limiting visibility to as little as a thousand meters. Air reconnaissance was limited mostly to signals intelligence data, which meant that finding where the IRG divisions were located, would be up to the 2nd ACR. Like the prairie horse soldiers of 150 years earlier, the troopers of the regiments would grope forward until they physically ran into the enemy, in this case the IRG Tawakalna Division. Generally known to be the best and most aggressive of the various IRG formations, Tawakalna was the unit that would bear the brunt of the coming battle with VII Corps. As 2nd ACR moved forward, the regiment’s three squadrons were line...

Vimy Ridge In Canad Rhetorical Analysis

...John Pierce published an article in Laurier University’s Canadian Military History journal in 1992, which suggested that in the summer of 1936, “the historical reality of the battle was re-worked and reinterpreted… to symbolize Canada’s coming of age.” The construction of the memorial at Vimy began in 1925, and was intended to represent the entire contribution of the Canadian Corps to the First World War. Further, the monument served as a commemoration to the 19,000 Canadian soldiers who had been buried in unmarked graves. The inscription of the names of these men, the vast majority of which had not given their lives at Vimy, had the effect of “transforming Vimy into hallowed ground, an empty tomb, a place of pilgrimage” according to...

...at 5:30am 30,000 Canadian soliders who formed the Canadian troops accomplished something that the French and British has failed to do in two years. Leading the Canadians into battle was master and commander Arthur Currie, he was the first Canadian to lead the Canadian troop. Currie developed a new artillery war strategy called the "creeping barrage". The Canadian were given the task of recapturing the ridge, they built railroad tracks so their artillery could keep up the creeping barrage against the German position. When the Canadians weren't controling the front lines they were in a secret training area practicing their assault plan, this new tactic allowed the Canadians to advance on the German trenches that were at the base of the ridge. One of the reasons why they Canadians manage to do things successfully was because the Canadian corps soldiers were given maps of their objectives and given instructions to each individual. This allowed each man knowing what he was doing in the periods of time given, the planning was done until the very seconds to when it would happen. On April 9th 1917 at 5:30am, the Canadians corps begin firing all the field guns This battle gave Canada a new identify, an identity which would give them a much more respected title. The Canadian soldiers who did the impossible of taking over the ridge which was something the French and British had failed the accomplish Paris peace conference The Paris peace conference was an...

How Did Canada Capture Vimy Ridge

...Ridge, but the battles always ended in a stalemate because the Germans had the advantage of controlling the ridge. The ridge, located in France was much higher than the rest of the flat plains which made it both an offensive, and defensive position. Apart from driving the Germans further back, this was another reason why the Allied forces wanted to capture Vimy Ridge in the first place. Finally, after many failed attempts and over 100,000 casualties, Canada was assigned to capture Vimy Ridge. Planning & Preparation In order for the Canadian corps to capture Vimy Ridge, lots of meticulous planning and training was done. The Canadians dug tunnels and bunkers underneath the ridge so that at the time of the attack, they could use them to transport troops secretly, store ammunition and sometimes even detonate areas. Likewise, they rehearsed the battle strategy countless times and finally, a week before the actual assault, the Canadians corps continuously shelled enemy bunkers and trenches to weaken their forces and to keep them from knowing when the attack would start. The Battle...

... We all breathe the same air. We all cherish our children's future. And we are all mortal." On October 14, 1960, in the wee hours in the am, Senator John F. Kennedy spoke to a crowd of eager students at the University of Michigan at a presidential campaign speech. In his improvised speech, Kennedy asked, "How many of you, who are going to be doctors, are willing to spend your days in Ghana? Technicians or engineers how many of you are willing to work in the Foreign Service, and spend your lives traveling around the world?" His young audience responded to this speech well with a petition signed by a thousand students willing to serve abroad in the Peace Corp program. Kennedy asked R. Sargent Shriver, to direct a Peace Corps Task Force. Shriver outlined seven steps to forming the Peace Corps in a remembrance to Kennedy in February 1961. Tanganyika and Ghana were the first countries to participate in the program. President Kennedy welcomed the inaugural group of volunteers at the White House on August 28, 1961, to give them a personal farewell before their departure to Africa.
