On January 6, 2012 Beverly Perdue, a first term democrat and the first female in the history of the state North Carolina, to govern announced she would not seek a second term in office. This could justify need for differentiation but could it also justify a need for a special education program? To answer the question pose, first we have to answer why there is a need for a special education program? Horace Mann explains it more eloquently; he says “education, then, beyond all other devices of human origin, is the great equalizer of the conditions of men, the balance wheel of the social machinery”. ...Should public schools continue standardized testing? The United States government implemented the 2001 No Child Left Behind Act (NCLBA), signed into law on January 8, 2002 by President George W. Bush (US Government Printing Office, 2002). This Act requires states to develop assessments in basic skills. In order to receive federal school funding, states must give these assessments to all students at select grade levels. The Act does not assert a national achievement standard. Each state develops its own standards (US Government Printing Office, 2002). Since the creation of this act, various debates challenge the practical use of the standardized tests. The debate presented for this paper is an argument, “Should public schools continue standardized testing?” The favorable arguments are that the standardized tests are fair, backed by parents, improves the quality of the curriculum, and the usage of standardized tests outside of the public education system. INTRODUCTION This Article explores the evolving framework of nexus and examines the constitutional constraints imposed on states’ tax jurisdiction and how states overcome those limitations. In 2010, the Washington State Legislature declared that out-of-state businesses with no physical presence in Washington were earning significant income from Washington residents by providing services or collecting royalties on the use of intangible property in the state.1 The Legislature also determined that, although these out-of-state businesses did not have a physical presence in the state and were not paying their fair share of Washington State taxes, they were nonetheless receiving the following significant benefits provided by the state: • Laws providing protection of business interests or regulating consumer credit; • Access to courts and judicial process to enforce business rights, including debt collection and intellectual property rights; • An orderly and regulated marketplace; and • Police and fire protection and a transportation system benefiting in-state agents and other representatives of out-of-state businesses.2 * Armikka R. Warren Florida State University Donald Tomaskovic-Devey University Massachusetts, Amherst Research Summary Scholarly research has documented repeatedly that minority citizens are disproportionately stopped, searched, and arrested relative to their baseline populations. In recent years, policymakers have brought increased attention to this issue as law-enforcement agencies across the United States have faced allegations of racial profiling. In the 1990s, the politics generated by accounts of racially biased policing placed heightened pressure on law-enforcement agencies. However, to date, few studies have explored whether the increased social and political scrutiny placed on police organizations influenced or changed their general pattern of enforcement among black and white citizens. Using data in the search and citation file from the North Carolina Highway Traffic Study, this research specifically examined whether the politics generated by the media coverage of racial profiling and racial profiling legislation in North Carolina influenced the search practices of officers of the North Carolina State Highway Patrol’s drug interdiction team.
