In researching Hospital Corporation of America (HCA), I find that their public statements pertaining to their ethics program and practices are no more ingenious, enlightening or educational than the thousands of other healthcare organizations in the United States.5 There are over 595,800 healthcare organizations in the United States1; each with their own version of an ethics program. My opinion is that HCA has done little above the minimum requirements set forth under the federal sentencing guidelines as a result of the Supreme Court decision concerning United States v. Booker in 2005.2 It appears from reading HCS’s policies and procedures concerning its current view on ethics, HCA is only nominally serving its stakeholders and the environment through these policies. As a result of instituting the ‘bare minimum’ in oversight, HCA has experienced significant ethics violations. In May of 2000, HCA agreed “…to pay $745 million to resolve related civil charges…”3 In December of that same year, HCA was forced again “…to pay $95 million in fines and penalties to settle criminal charges of Medicare fraud…”3 As recently as December 2002, HCA additionally “…agreed to pay the government $1.7 billion in fines and penalties related to 14 counts of defrauding Medicare and Medicaid…The total in penalties is the largest settlement ever recovered by the federal government in a health care fraud case…”4 It is clear that as of 2003, HCA was not living by its ethical values, policies or procedures. HCA needs to recognize the lack of ‘robustness’ of their current policies, especially as it pertains to their training regiments. I think that by potentially teaming with similar, successful organizations, HCA could greatly improve their current training system to make it more effective and applicable.
