Introduction:
Good morning Your Honor. Our names are: (as follows) and it is our pleasure to be representing the defendant, Ms. Brittany Spares, in this case. The defendant was accused of Driving While Intoxicated and leaving the scene of the crime, two very serious crimes. At the end of this case, we will be seeking a verdict of not guilty.
Theme:
Ladies and gentlemen of the jury, this is a common case of mistaken suspect. and diminished capacity. The defendant was identified through improper and uncertain means; with officers using only the model of the vehicle and common damage. Furthermore, the officers invalidated the evidence via the exclusionary rule when they entered Ms. Spares’ Dwelling without a search warrant.

Spares, was the one driving the car. They did not give any specific evidence of having seen the defendant in the car. The state also said the defendant was found intoxicated in her home. They stated that she admitted to be drunk, and once they tested her, she registered a blood alcohol content of .15. This evidence can not be used because they entered the defendant’s house without a search warrant, consequently, this excludes all of the evidence they obtained as a result of the blood-alcohol test. any evidence they had found.
