PERSONAL INJURY PROTECTION

Personal injury protection (PIP) reimburses medical expenses for covered individuals, regardless of fault, for treatment due to auto accident. PIP covers the driver and any other passengers injured in the vehicle. PIP coverage may also be available for pedestrians injured by a vehicle. Personal injury protection also pays for funeral expenses, lost earnings, rehabilitation, and replacement of services such as child care if parent is disabled. PIP does not cover damages made on the car or any other personal property; it is just an extension of car insurance that is available in some U.S states. Not all states require personal injury protection insurance. Some states actually make it mandatory to have PIP insurance. Reimbursement from PIP payer is based on individual state laws and is provided on a per-person, per-occurrence basis. Personal injury protection is also referred to as “no fault” coverage because the statutes enacting it are generally known as no fault laws. Personal injury protection is designed to be paid without regard to “fault”, or legal liability.

To determine coverage, the automobile insurance company’s medical adjuster reviews healthcare bills submitted to company for treatment of injuries sustained. The minimum benefits given are: 1. Up to 10,000 for reasonable and necessary medical expenses for each person injured in an auto accident. Available for up to 3 years from date of accident. 2. Up to 2,000 for funeral expenses. 3. Up to 200 per week (10,000 total) for income replacement coverage. This is limited to one year after someone’s been disabled for 14 consecutive days after accident. 4. Up to 200 per week (5,000 total) for loss of services (payment to non-family members for work you cannot do).

Determining Your Limits for Personal Injury Protection
In some states, personal injury protection is mandatory. In other states, personal injury protection is not available at all. If personal injury protection is available in your state, you should consider what your health insurance will cover and what it will not – and how the following expenses could be impacted should you or someone in your household be injured in a car accident.
Medical Expenses – Personal injury protection can pay reasonable expenses for necessary hospital, medical, surgical, optical, dental, chiropractic, rehabilitation, x-rays, prostheses, prescription drugs, ambulance and nursing costs.
Work Loss – Personal injury protection can pay for loss of income due to injury, including costs incurred by a self-employed person who hires substitute employees to perform necessary tasks and to maintain income.
Funeral Expenses – Personal injury protection can cover reasonable funeral and burial or cremation expenses.
Survivors’ Loss – Personal injury protection can pay for loss of income and replacement services to the surviving dependents.
Essential Services – Personal injury protection can pay for essential services, such as household maintenance, to replace those normally performed by the injured person.
