Facts: Casey Martin was born with a disability that causes him to deal with pain and complications in his body he is also an accomplished golfer. While playing in the PGA tournament all players must play by the same rules. The National Collegiate Athletic Association exempts Martin from this rule near the end of his college career. The other is whether a physically challenged competitor be turned down the use of a golf cart because it will basically change the essence of the tournaments to give him consent to ride when all the other players is required to walk.
District Court decision: entered a preliminary injunction in favor of Martin allowing him to use golf cart in the competition. PGA filed motion for summary judgement under Title III of the ADA as a private club arguing it does not establish play areas as places of public accommodation. PGA argument is rejected and motion for summary judgement denied.
Court of Appeals decision: judgement is affirmed the appellant court agreed with the District Court’s ruling. The golf course play areas are considered as places of public accommodation for PGA tournament.
