The Tax Court found that this strategy violated the major tax code concept that “first principle of income taxation: that income must be taxed to him who earns it.” [Commissioner v. Culbertson, 337 U.S. 733, 739-740 (1949).] First, the significant finding was that although Johnson signed a contract with PMSA (and later this was transferred to another corporation, EST), the compensation agreement was between Johnson and the basketball team/club, and that no such agreement existed between the club and the corporation.
