Mission/ Purpose | The SpokR Group has been contracted to create a mobile application which will connect the owners of underutilized bicycles with potential renters. The objective is to promote a healthy living lifestyle while being eco-friendly. The company’s objective is to see a profitable return on investment within the first twelve months. | SOW | This project will consist on creating a web system and an application that will benefit people from a certain community or city to find a bicycle that will fit their requirements for them to be able to rent it. The project will be completed by February 28, 2015. The application will allow for users registered as 'Renters' to search and connect with users registered as 'Owners'. The renters will be able to search for available bicycles listed by the owners. Search parameters will include location, bicycle type or price. The system will process payments from the renters and to the users. JULIE CASSIDY* Unlike the constitutions of many nations, such as the United States of America and the Republic of South Africa, the constitutions of the Australian States and Territories and the Commonwealth Constitution Act 1901 (UK) contain no bill of rights. Australia is the only western democracy without a federal bill of rights. The debate regarding the need for a bill of rights necessitates an understanding of what human rights the people of Australia already enjoy. If sufficient protection can be found in existing sources, does Australia really need a federal bill of rights? Opponents of a bill of rights state that we have sufficient protection from arbitrary government intervention in our personal affairs and thus a bill of rights is unnecessary. There are a number of potential sources of human rights in Australia that might provide the suggested existing protection, including the common law, specific domestic legislation, international law and constitutional law. Each of these sources of human rights has, however, important limitations. The focus of this article is on the inadequacy of the Australian constitutions as a source of purported protection. A bare majority held that the Fourteenth Amendment required every state to perform and to recognize marriages between individuals of the same sex.2 The majority opinion ended with these ringing words about the plaintiffs: “Their hope is not to be condemned to live in loneliness, excluded from one of civilization’s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right.”3 While Obergefell’s most immediate effect was to legalize same-sex marriage across the land, its long-term impact could extend far beyond this context. To see this point, consider how much more narrowly the opinion could have been written. It could have invoked the equal protection and due process guarantees without specifying a formal level of review, and then observed that none of the state justifications survived even a deferential form of scrutiny.
