...GM520 1) The administrative agency which I choose is the Small Business Administration (SBA). The reason why this agency and the proposed regulation interest me is because I have worked for the Social Security Corporation in the businesses development department where I worked on micro projects and small businesses. The way this regulation that has been proposed may affect me is by enhancing my experience in small businesses. 2) The proposed rule made by the Small Business Administration is on the size standards of small businesses of some 35 industries of the North American Industry Classification System, NAICS, and other services. The regulation proposes an increase in the size standard of the relevant small businesses. The regulation also proposes an eight-size-standard-level methodology. 3) In my public comment I would propose that the regulation should not be limited to the increase of size standards but it has to examine the quantity standard, which means to add more industries to be included in these small businesses. 4) The deadline for the comments on the regulation was June 15, 2011 5) (a) I could not submit my comments because the deadline was past due. (b) Although I am in favor of the proposed regulation, these are the five legal theories I could use to overturn the regulation in court: 1- Arbitrary and capricious. The agency has to show evidence that supports their proposal and they must explain this evidence to prove the rational connection...

Competitive Bidding

...well-established aspect of all industries and businesses. Vendors usually present a proposal that must meet specific requirements needed by the buyer. These specifications are called Request For Proposal (RFP) or Request For Quote (RFQ). As a routine, sellers present their bids in a written format after discussing all aspects of the specifications with the buyer. It is important to note that when the purchasing is done from women-owned or minority-owned firms, a stricter more complicated process is involved since more qualifications asked of them. The same applies to small-businesses. Small businesses that use competitive bidding usually have prior experience of the process. However, if they small business lacks the proper and prior experience, it may have to educate itself with culture ad nature of competitive bidding. To help with such need, the US Small Business Administration (SBA) provides excellent learning resources for these small businesses in order to properly get involved in competitive bidding. There are major elements of this process that are important to both the buyer and the seller. From the point of view of the buyer, it is always important to identify the right supplier who has prior experience and full resources needed to meet the requirement of the bid. Some examples of experience involve qualifications, prior achievements, responsiveness, and of course cost. Since evaluating a proposal is time-consuming, buyers usually require bidders to go through formal qualification...

Federal Contract Law Overview

...to direct purchases made by the government, but also to purchases made by federal grant recipients (Feldman, 2010). The government procurement team is made up of the Contracting Officer (CO), Administrative Contracting Officer (ACO), and Termination Contracting Officer (TCO). The government planning process consists of market research and an internal source search before they proceed with full and open competition which allows all responsible sources to submit either a sealed bid or competitive proposal on the procurement. The market research consists of availability and quantities of items, and reasonable prices. Internal sources include existing inventory, excess from other agencies, and federal prisons (Feldman, 2010). Feldman (2010) states that sealed bidding and competitive negotiation are the government’s predominant procurement methods. In sealed bidding there is an Invitation for Bid (IFB); in competitive bidding the government generally issues a Request for Proposal (RFP). Price reasonableness and source selection must be proved on all federal procurements. Congress did exempt certain...

Case Analyses- Request for Proposal

...Case Analyses- Request for Proposal The Request for proposals (RFPs) is used in negotiated acquisitions for the procurement of supplies and services (research and development (R&D), construction and commercial items), by the contracting officer issuing a solicitation to communicate the government needs to prospective contractors. The policies and procedures that govern RFPs vary between the procurement of commercial items and construction. The purpose of this paper is to compare the two RFPs and identify the differences. The Federal Acquisition Regulation (FAR) requires commercial items acquisitions exceeding $5.5 million to be solicited using the RFPs contract method and solicitations is prepared using the standard form (SF) 1449. The commercial items RFP used in this comparison was issued by the Department of Veteran Affairs (DVA). The requirement is to provide inscription for blank marble niche covers for Arlington National Cemetery. The acquisition is being set-aside for service-disabled veteran-owned small business (SDVOSB). The period of performance is for a base period and four option years. The option clause to extend the term of the contract is included. The option clause does not obligate the government to exercise the option years. The government may exercise an option by providing the contractor with a written notice within the time specified in the contract. The phone is design to provide a wireless Internet connection, music, and talk into one. The features of this phone include a 3.5 touch screen without the aid of a keyboard, using more than one finger to control the phone, and shifting the screen to view in different modes. The market for the phone was small in 2008; but today the phone has taken over. In this paper I will present a business proposal for the iPhone addressing the market structure and the elasticity of demand for the phone. Market Structure The Apple smartphone is part of an Oligopoly market; an independent market and has its own behaviors strategies. According to McConnell, Brue, and Flynn (2009), “Oligopoly, in contrast, blends a large amount of monopoly power, a small amount of competition through entry, and considerable rivalry among industry firms” (p. 222). Because Apple’s smartphone industry and competition was small, it needs to take control of the market by differentiating the iPhone from others phone in its category...

Commenting on Administrative Regulation Proposals

...1. The administrative agencies that control this regulation: The Department of Defense, the General Services Administration, and the National Aeronautics and Space Administration and subsequently, the Small Business Administration. This regulation would affect me as a small business owner because it would change the way all levels of government do business with privately -held small businesses, such as mine. 2. This is a proposal to amend the Federal Acquisition Regulation (FAR) to include government-wide, standardized past performance evaluation factors and ratings categories, and that this past performance information be entered into the Contractor Performance Assessment Reporting System (CPARS). 3. My comment: While I concur that the FAR should be amended in this way, I believe that the current proposal is too vague to be effective. Standardizations tend to group things into categories that are either “black” or “white”, causing a great injustice to those who would only fit in areas of “gray”. Therefore, I suggest a thorough investigation into the actual effects that the proposal would have on all businesses- large and small, experienced and novel, old and new, etc. I also believe this proposal should not be enacted until real evidence, showing complete equality and fairness among all businesses, is presented to and reviewed by the public. 4. This expires on November 5, 2012 5. A. Based on the Administrative Procedure Act of 1946, if I choose, I would...

Managing Major Sales - 7 Steps That Could Change Your Business

...Managing your Major Sales - 7 Steps that could change your Business Mike Wilkinson of Axia Value Solutions looks at ways of improving performance, lowering costs and building profitability Ever lost a sale you thought was in the bag? Not an unfamiliar feeling for many businesses large and small. No matter how good you think your product or service is, everything finally boils down to your ability to convince others that it is good for them. It is all about getting the decision makers who matter to say "Yes". In major sales the whole approach is fundamentally different to small scale selling and requires a very different set of skills and techniques. Being competent in the small, simple sale is no guarantee of success in larger scale selling. The traditional techniques and "tricks of the trade" such as closing don't seem to work in quite the same way in the more complex large scale sale. They are replaced by precise planning, information gathering and behavioural skills that build trust in the minds of the decision makers. Fundamental to this is the development of a detailed understanding of how decisions are made in your target customer and who the key players are. So what constitutes a major sale? For most businesses they have a number of characteristics: 1. A lengthy sales cycle. This can vary from a few days to a few months or more depending on the industry. 2. Multiple decision makers. Any decision becomes complex as soon as more than one person is involved in making it...
