Prosecutions Proposal
Last October, a young woman who was urgently attempting to get her life back in order was heartlessly and viciously killed. The defendant refuse to accept his action in this ferociously and inhumanely act that was committed on this young lady. He will rather act as if he was insane than to man up on his responsibility. Uma Opee was adored, respected, and liked by her family and friends. Opee was not a perfect young lady, but she was a changing young lady. She did have a criminal record for minor crimes, drugs, and shoplifting. Opee followed the judge’s order and along with a plea deal she took advantage of the drug rehab program while trying to turn her life around. However, the drugs that Opee frequent used in her life is unlike the same experiment many young people are doing now of days. Even after the drug rehabilitation that the judge order her to she turn back to the drugs and the bad company. Her shameless choices should not be a reason that Uma Opee life was taken by this heartless and ruthless defendant. Ms. Opee and the defendant were introduced by shared friends that they every now and then used drugs with and immediately became a couple. When Opee finished rehab she distant herself from the defendant. Ms. Opee wanted to change her life and dragging the defendant in her life was only going to set her back and not help her at all. This young lady went back to school to focus on her education and she in love with her full time job. Her friends believed that she was on the right track and she was in decent place in her life while making improvement in her life and decision making. The music store was her passion and her co- workers said that she was reliable and dependable person. The defendant was seen buying a knife prior to the death of Uma Opee. The testimony of the clerk at the gun shop showed that the defendant was very rational

The prosecutor works for the plaintiff and the state's case, and they show the gathered evidence that proves that the person accused of the crime is guilty of committing it. The defense attorney's job is to give evidence that proves that the accused is not guilty. If you are accused of a crime, you will share a table at the trial with the defense attorney. The prosecutor tries to prove your guilt, while the defense attorney does their best to prove that you are innocent. The defense attorney works on their own for you, but the state pays the prosecutor. A person can, and would, hire a defense attorney, but never a prosecutor. Even though public funds are paid to prosecutors, they are not employed by the government. The person who they defend pays the defense attorney – the prosecutor is responsible for representing the government when they bring a suit against an accused criminal. Can our client satisfy the first requirement for a malicious prosecution suit that requires that the termination of the earlier suit be in the plaintiff’s favor when in our client’s case their termination was due to a voluntary dismissal by the initial plaintiff who changed her mind about her claim? To meet the first element –favorable termination- a plaintiff cannot rely on a settlement of the case that both parties agree to. Once the litigation ends by settlement there is no favorable termination for the purpose of pursuing a malicious prosecution.
