The Reasonable Person Test Explained
The ‘reasonable person’ test is one of those legal quirks that form an enduring part of the common law, despite being very hard to actually define. And judges in various forms have always had the task of determining if the damage caused was something that the ‘damager’ is liable to remedy. In a way, a bit of retrospective risk assessment has to be carried out by the courts in these cases. Certainly, most torts (the kinds of acts or omissions that cause damage) are caused by pure accidents or mistakes.
Yet it’s never as simple as ‘oh, look, a mistake was made – let’s all move on’. Due to the fact that within law the ‘reasonable person’ has a hypothetical presence in workplaces, schools, homes, streets and venues, it pays to understand the basic ideas and applications embedded within this legal standard. And in the context of workplace risks and potential litigation, it is particularly useful benchmark for employers and managers to keep in mind. Does reasonable mean average? The short answer to this is – no. Using allegory to pin down this tricky concept, judges since the 19th Century have variously named the fictitious reasonable person (then always a man). But the ‘reasonable person’ is actually a little better than the ‘average’ one. He or she will be quite risk-conscious, a little careful with activities, and very thoughtful when it comes to looking out for possible risks and dangers. Yet the courts never endowed our fictitious reasonable person with 20/20 hindsight. In considering whether a person was harmed by the actions or inactions of another, decision-makers will take into account the circumstances and available information that existed at the relevant time. Our reasonable person is certainly quite prudent – but not invincible. The ‘reasonable person’ in the workplaces Risky and unfortunate situations arise

The Person Who Is Responsible For The Deaths Of Romeo And Juliet Essay

...Pittet 1 Maddie Pittet Mr. Swanson English 1 February 11th, 2016 Romeo and Juliet Romeo and Juliet is a tragic story about young love. In the end, their love proves dangerous and there are many theories as to who is at fault for their unfortunate deaths. Many characters throughout the story certainly contributed to the passing of Romeo and Juliet, but who’s really to blame? The truth is, it is not just one person that caused their deaths, but in fact many characters throughout the story. Lady Capulet, Lord Capulet, Lady Montague, and Lord Montague began the feud that eventually forced their children to hide their love for one another. As Lady Capulet once said, “ Marry, my child, early next Thursday morn, the gallant, young and noble gentleman, the county Paris, at Saint Peter’s church, shall happily make thee there a joyful bride.” (Act 3, Scene 5) Forced marriage...

Essay on Myself

...am a responsible and sympathetic person, however, I am a self-centered person as well who may have made enemies with a lot of people. I am a pretty responsible person and I do what I am supposed to do. As now, I am a student in school, therefore I do my homework every single day and study for what I have learned at home. I also pay attention in class most of the time as well. Besides that, I organize my work as well. At home, I am a child, so I respect my parents and help them to do house works, such as doing laundries and washing dishes. I clean my room once a week as well because that is my responsibility as being a child. I also help out friends and classmates when they need help. I give out advices and suggestions to them when they need support and help as well. Generally, I can say that I am a responsible person who does my duties. Besides being a responsible person, I am also a person who is sympathetic. I have been a sympathetic person when I was really young. For example, when I walk on the street and saw some handicapped people or vagrants, I would help them by giving them money or whatever things that I can do for them to have a better living. When I see animals without a home, I feel sorry for them and I might buy some food for them to eat. I used to donate money to the charities for orphans with my family as well. I feel sympathetic to many people in the world and therefore I do something to help them have a better living. Even though I am a sympathetic person, however...

Personal Responsibility

...Personal Responsibility? Personal responsibility is defined by Merriam-Webster (2012), as: “Responsibility: the quality or state of being responsible; as moral, legal or mental accountability.” This definition can take on many annotations. It is my opinion in regards to this paper that Personal Responsibility is what makes up a person’s ‘moral fiber’. It is the ability to make decisions based on what a person feels is right or wrong. It is that little voice in the back of a person’s head that guides them when life presents choices and challenges. Those who possess Personal Responsibility tend to make wiser choices and decisions in life. These wiser decisions are made for the fact that they know that they will be held accountable for their actions. Personal Responsibility is the hallmark of success in all aspects of a person’s life. It is that individual who makes the wiser decisions in life that will tend to be more successful in life. Individuals have the choice to make right and wrong decisions in life. Galindo (2010) states “It is their morals, ethics, and personal responsibilities that guide them through life in their decision making process.” A persons ‘moral fiber’ is defined by how they make those decisions. Will the individual be responsible and make the right decision or will he possibly make an easier, less responsible choice? Is the thought that nothing may happen to them if they make the wrong choice guiding their decision making process? Far too often...

Being Late Talks a Lot of Your Personality

...understand the importance of arriving early and how other people could feel about that. In this essay I am going to talk about why people are late in Venezuela, why being on time is so important for academic success, for students, and how this behavior talks about your personality. For some people, being on time seems nearly impossible; no matter how important the event is. For example, I have a friend who when I asked her out and established a specific hour to arrive, she is always about 40 minutes late. One day, she made me wait for around 2 hours. I was really angry because I felt like I was losing my time. I thought this carefully because recently I have been late a lot and I hate people to wait for me and I don’t want to be an immoral person. I have been telling myself that each time I am late, I have to think honestly about what sort of behavior is causing me to be late, and I write it down. Writing something makes it more serious and it’s like I am taking more responsibility for changing something if I write it down. After that I think about what my priorities are and why some people from Venezuela are late because they simply do not have enough time to...

This means things like paying your bills, being clean, doing your course work, and being honest in your relationships. • Without being responsible for your own actions you cannot achieve college level success. You must be willing to bear down and do work no matter what gets in the way. You have a duty to yourself to see things through. If you are responsible in personal and educational life you will be successful in your college experience. To be responsible in college life you must tackle your course work to the best of your ability in a timely manner. This also means when you are working with a group you have to be responsible for your share of the work. There are times when they may have to, but if you show yourself to be a hardworking and honest person your team mates will not be so upset when they have to help you out. • I plan to practice responsibility by being the best that I can be. Personal Responsibility

...each and every facet of a person’s existence.  Achieving personal responsibility does not necessarily suggest that you can govern everything that transpires, but it does mean you can control how you react to those situations.  Personal responsibility means being accountable for one’s actions as well as acknowledging the ramifications of those actions. “Parents can only give good advice or put them on the right paths, but the final forming of a person’s character lies in their own hands” was a insightful quote by the late Anne Frank. By not being personally responsible an individual is likely to blame others for their transgressions which can result in a magnitude of negative consequences. Becoming depressed and frustrated with individuals other than oneself is among those downsides. Failed friendships and even failed personal relationships can also occur because of an individual constantly blaming another person for their own faults.   To me, when you accept responsibility for the situations in your life, you are then capable of learning from that certain situation thereupon permitting you to progress. Accepting this particular responsibility will not allow you to remain stagnant. Sustaining personal responsibility can prove to be a bit difficult at times but it also helps to establish success regardless of what you are striving for.  This especially applies to college success.  Michael Korda once stated “Success on any major scale requires you to accept personal responsibility…”...
