Sex Crime Laws

...Introduction There are certain crimes today, which invoke a strong personal reaction. What is your first mental image and what emotion do you first notice when you hear the term, “sex offender?” Do you picture a scary looking male stranger? Is your first emotion, anger or maybe fear? Now, what is your initial reaction when someone says that the post-sentencing laws for these offenders may be doing more harm then good in regard to current legislation passed after high profile cases. Are sexual crimes all equally heinous, justifying opinions that the offender did the crime so they should accept the consequences? I believe that these laws were created with the best of intentions. Yet, these laws are now creating alternate paths to dangerous alternatives and roadblocks to the goals they seek to achieve. Legistation On October 22, 1989, an 11-year-old boy named Jacob Wetterling was abducted from a small town in Minnesota (Hawkins, 2009). Jacob and his two friends rode their bikes into town to a convenience store to rent movies (Hawkins, 2009). On the way back home, a gunman stepped out of the woods, and told Jacob’s two friends to run into the woods and not look back (Yoder, 2011). Jacob, who stayed behind, has never been seen since (Yoder, 2011). A massive manhunt ensued with law enforcement from all over, however their exhausting efforts never led them to finding Jacob or his abductor. This case captured headlines all over the United States and in 1994 it prompted......

Handling Sex Crimes/Offenders

...Nathan Fiecke CJS 425 Free Write #2 Handling Sex Crimes/Offenders I have learned a lot about sex crimes and sex offenders that I had no recent knowledge of or even knew was possible. I have been informed of different ways that these offenders are handled and how people have looked at sex crimes, whether it was Frank Weber telling us about his new way of rehabilitation or when we were told about what these offenders are supposed to oblige by when they are on probation. We also heard about some of the most famous sexual abductions and crimes when someone from the Jacob Wetterling foundation came in and gave her presentation. These gave me a different outlook on sex offenders and whether locking them up or rehabbing them is the best choice. I think that the most appropriate response to sex crimes and offenders is the exact way Frank Weber does it. Sure he has to go to court and sort through all the lawsuits but I think he is starting a new trend in sex offender rehabilitation since he has such a high success rate. When I was listening to him speak about the way he handles these offenders in his program I couldn’t help but agree with every technique he uses. Whether it’s the polygraph test, the journals, and speaking to the families. I believe that probation is a good choice but not as life changing as rehab. I mean the offenders are being looked upon all the time and being watched so they don’t act out on their impulses. The officers keep pornography and all other......

Cruel and Unusual Punishment or Effective Control of Sex Crimes

...Betty Waltermire Critical Issues in Criminal Justice JUS-250 April 10, 2014 Cruel and Unusual Punishment or Effective Control of Sex Crimes In the Bill of Rights we look to the Eighth Amendment to read; Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Excessive or disproportionate to the offense committed. A male who has been charged with and convicted of multiple sexual crimes, is going to do his time, get out of prison and offend again. To impose upon him to be chemically or surgically castrated would this procedure stop or prevent the sexual crimes from occurring. In China and the ancient world the rulers kept many wives and concubines so they would have an heir. To protect them from being impregnated by another male they used eunuchs to guard the wives and concubines. They were appointed to guard the royal household and through daily contact with the family they gained immense power (Chinese Eunuchs). According to legend castration has been used to improve the effectiveness of soldiers. The rulers would castrate the men by removing the penis and leaving the testicles. This would cause them enormous sexual frustration and they would become violent and aggressive, which was perfect for the battlefield. Chemical castration is done by injection of the FDA approved birth control drug Depo Provera to lower the testosterone levels in men, thereby......

Military Rape

...Amidst the intensity, the struggles, and the pressures of war, it’s understandable that soldiers overseas may not always behave in accordance with social norms. This line, however, is crossed when that behavior is exaggerated to the point of abuse towards fellow soldiers. According to interviews with women in the military who have returned from war, the amount of sexual harassment they are forced to endure has not only increased, but has been written off by officials and fellow soldiers. An act of sexual harassment towards anyone should be dealt with and the abuser should be punished, not disregarded or hidden. These statistics and reports should be publicized, in order to prevent the perpetrator from violating another, and help women soldiers know they are safe to come forward with their allegations, instead of hiding in fear of her superior officers. According to the military, sexual assault is defined as “rape; nonconsensual sodomy; unwanted inappropriate sexual contact or fondling; or attempts to commit these acts” (Benedict 7). With such a substantial number of women joining the armed forces, these boundaries are being crossed more and more each day. Women today consist of fifteen percent of active duty forces, while a 2003 survey states that thirty percent of female soldiers were sexually assaulted by a fellow member of the military (Benedict 11). Not only are these women dealing with surviving attacks from insurgents, but now they have to worry......

Rape, Pornography and Sexual Violence

...news, your mind begins to think of the type of person who could commit such a violent sexual crime against another person. The perpetrator of this act usually wants to feel powerful and be controlling over another person. There could be any number of reasons a person needs to dominate another, one of the biggest reasons is, because they may have been sexually abused as a child or teenager. We ask ourselves could pornographic materials be the cause of the rape. In 1989, Susie Bright, a supporter of erotica for women gave a public lecture to defend pornography against recent attacks. Bright talked about whether or not pornography causes rape. Her view that it does cause rape as, “the devil made him do it.” To believe that pornography causes rape, we must accept that we are letting the rapist off the hook. If we indicate that the pornography caused the rape, then we cannot also say, that it was the rapist who caused the rape (Adams). The most important charge against pornography, that it incites sexual aggression. Although rape statistics suggest otherwise, some experts believe the consumption of pornography may actually reduce the desire to rape by offering a safe, private outlet for their deviant sexual desires. Rape from a moral standpoint, is simply a more extreme form of a desire to use and objectify others who are at the root of the pornography industry (Darwin, 2012). Many sex offenders consume an extreme amount of pornography and some even claim that the......

Sexual Harassment & Assault Prevention Situation

...ABSTRACT A Sexual Offense is a serious issue. The United States Military has a “zero” tolerance for sexual offenses. Sexual offenses include sexual assaults, sexual harassment, sexual violence and sexual abuse. As an NCO we need to ensure the safety of our Soldiers and do everything in our power to prevent a sexual offense. If a sexual offense happens it is our responsibility to manage it in the proper way. The Sharp Program is a combination of two Army programs. The SAPR (Sexual Assault Prevention and Response) and the POSH (Program and Prevention of Sexual Harassment). On 6 February 2004, Acting Secretary of the Army Mr. Les Brownlee established a task force. The task force was responsible for reviewing Army policies on reporting and addressing allegations of sexual assaults. The finding of the taskforce led to the implementation of the SHARP program. In September 2008 the Army launched phase I of the Sexual Assault Prevention Strategy and in April 2010 the phase II Army wide roll out began. (SHARP Facts, n.d.)   INTRODUCTION Sexual violence is an increasing problem in the armed forces, no matter your gender, age or race. The Sexual Harassment/Assault Response and Prevention (SHARP) has been a yearly briefing, since its inception in September 2008. The SHARP program was developed to ensure Soldiers understand what a sexual offense is, how to deal with a sexual offense and possible steps to prevent a sexual offense from happening. It also strives to......

Women and Work in Canada

...Women and Work in Canada - Sociology 345 Assignment 3 Essay Prevention of sexual harassment in the workplace is a concern in Ontario. It is agreed that sexual harassment is a form of gender discrimination and is recognized as a violation of human rights, however it still exists today. Sexual harassment violates women, lowers their self esteem, and leaves them feeling helpless, and in some cases trapped in a job that they cannot afford to quit, so they endure the harassment. Employers suffer because it creates a hostile work environment, productivity may decline, absenteeism increases and there is a high turnover of staff which can lead to the loss of valuable employees. Although there are laws and Acts that prohibit sexual harassment, it is not easy to stop. Most women attempt to deal with their situations informally instead of taking formal action because they fear reprisals, such as losing their job or being treated unfairly (Hughes & Anderson, 2010). In addition, the inherent inequalities and social conditioning that occurs between men and women plays a major role in the struggle women face within the workplace. Although the government of Ontario have put several initiatives in place to counter-act sexual harassment, it is not certain that any of these initiatives are making a positive impact on the situation. This paper will examine the different initiatives taken to negate sexual harassment against women in the workplace. According to "Women and Work in......

...De La Torre, Pamela Z. 2015 – 46044 BA Behavioral Sciences This should be one of the Last Posts by females on social media platforms such as Facebook and Twitter which recount their experiences of men catcalling or inappropriately touching them and news articles on women exposing how they were physically abused and/or raped by colleagues or even high-profile men circulate and can be seen on our timelines and news feeds almost every day. Amidst these haunting cases are comments made by both men and women on how it was the female’s fault why she got raped or harassed in the first place and other posts about how women should dress and act so as not to get harassed or seen as “asking for it”. You have men thinking that it’s okay to say “hi ganda” or “miss beautiful, pahingi naman ng number mo” to ladies passing by because they don’t really get condemned for it as much as the girl who was wearing a short skirt when it happened. Such thinking exists that it’s okay to catcall women but it’s not okay for females to wear shorts on a hot day. Our own culture tolerates and even encourages sexual harassment by joking about it (Expanding the Anti-Sexual Harassment Law, n.d.) and society normalizes sexual violence committed by men (What is Rape Culture?, n.d.). This is rape culture, and it exists and prevails in the Philippines. Emilie Buchwald, co-author of the book Transforming a Rape Culture, defines the culture of rape as “a complex set of beliefs that encourages male sexual......

Every individual especially the male genders are crazy for sex relationship. Rape can also be defined as the condition where a male forces a female for sex. The following paragraphs shed some light on the causes of raping, the effects and the solution to this problem. One of the major causes of this incident is the will of male to try out new things. Most male nowadays are very aggressive and tend to be daring as well. They do not care about the consequences they will face if get caught doing wrong. Other than that, they are also influenced by the female appearance which makes them difficult to control their emotions. For some males, raping is considered as an act of taking revenge on a female they dislike, while on the other hand they are influenced by bad friends to indulge in free sex. This case also leaves its effects. The primary effect will be the rise in HIV and AIDS disease. The only good news in this is that it only spreads through sexual intercourse with the infected person. Besides that, females will be more prone to stay at home due to the feeling of scared of being raped by anyone. The rise in this incident also causes the disgrace to the male gender, especially the good ones who do not involve in this activity. In addition to that, the future of the victim also will...

Harassment

...behaviours that are subject to both criminal punishment and civil liability. On the criminal side, states have a wide variety of criminal laws forbidding harassment in many forms, including general harassment crimes as well as specific forms of harassment, such as stalking and cyber stalking. In Belize we see a number of females being harassment by males, but have we ever looked back to see where it started and it has become trendy? If we look around we see many male youths struggling; we see many that because of their upbringing they don’t know how to carry themselves, their level of maturity is causing them to still be in child-zone and the way females carry themselves cause them to react the way they do. In Belize, we see a major problem in parenting for youths. Children are being raised by youths because they have working parent that have little time for them, also some only have one parent so that parent needs to work double to make up for the missing partner. This lifestyle cause males to not have the proper upbringing on how to carry themselves when they are among the opposite sex. In today’s society a male thinks that by whistling, calling unwanted names and comments they can get a female attention. In their mentality this is the proper way to communicate with the opposite sex. This is a key factor why it is good to have a good male role model or even a strict parent to raise our male on how to be respectable citizens. Secondly, it is scientifically proven that......

Under Title 7 of the civil rights “race, color, religion, sex, or national origin” are unlawful to discriminate under. A person’s sex and gender need not to match one with another. Some men are more feminine than other men. Sexual orientation indicates his sexual attractions and desire, that’s person’s sexual attraction to other type people of the same as his is. Sex, gender, sexual orientations are interconnected. What is more important for purposes of the title 7 that courts often forcefully draw line between them. In the end sex and gender are protected by title 7, however sexual orientation is not. “Sexual orientation claims arises when an employee suffers discrimination solely on accounts of his or her sexual orientation. Law currently stands; sexual orientation claims are not actionable under title 7. This is true regardless of whether the claim is based on homosexuality, heterosexuality, or bisexuality” (Northwestern Universality Law Review, Title 7). John Smith and Joseph Oncale had almost the same issues when they both were harassed and discriminated at their work places. Unwelcome sexual advances, requests for sexual favors, verbal or physical conduct of any sexual nature represent sexual harassments. “When the workplace is permeated with discriminatory intimidation, ridicule, and insult that is sufficiently severe or pervasive to alter the conditions of......

Relationships, Women's Lib, and All the Other Stupid Stuff

...previous decades. Why is that? Could it be that by having children without marriage, child-rearing can be more difficult than we thought possible? Having children requires being flexible with the child's needs and children are the top priority. Otherwise, why have them? And so this became a terrible problem: children without fathers, left alone at home too often, fending for their own meals, watching too much TV, and spending time with their peers than with family. This became a compromise to women with a desire to get ahead in the workplace. Their children became a problem and their work suffered. So much for doing it all. See the book "Dinky Hocker Shoots Smack." Perhaps this is an extreme comparison, but judging by the crimes, social unrest, broken families, rise in drug intake, bitterness between the sexes, then maybe this is not so extreme an illustration after all.
