Smokings continue to lead our nation in death; in fact, it kills and robs many people of their health and quality of their lives. All over the word, we see signs and warning labels used to prevent smoking and protect none-smokers from the dangers of second-hand smoke. Our government continues to look for ways to ban smoking and save lives, therefore we will continue to trust our legislative, judicial, and executive branch to create, enforce and evaluate new laws daily.

This branch has the important role of evaluating different cases to make sure that no one’s constitutional rights are violated. This is carried out through the Federal Courts and the Supreme Court, which is the highest court of them all. Although the federal government have smoking bans in place to protect the American public, many companies still look for way to make profit off smokers. The U.S court is evaluating a case concerning a negative image of someone smoking. According to article “U.S court strikes down a graphic warning on cigarettes” (Ingram and Yukhananov). For example, Smoking companies feel like their constitutional rights were violated due graphic pictures displayed to convey a message, about the dangers of smoking. They are worried that if people see this image they would not smoke, and they would lose profit on tobacco products. Another example of a smoking ban violating ones constitutional rights is a warning label to promote tobacco products. “Federal appeals court strike down FDA tobacco warning label law” (Mears Bill). This case evaluates how the federal mandated law violates companies’ constitutional right to sell and package their tobacco products. The FDA failed to provide enough data to prove its case that was put in place in 2009 under “The Family Smoking Prevention and Tobacco Control Act” (Mears Bill).
