Take Charge in 90 Days: In the Third Person You

Introduction

The first ninety days taking charge of any organization, whether you are the CEO of a large conglomerate or the Commander of a ten man unit, when you are in the position to lead others you have the opportunity to exercise your tried and true leadership principles that will establish your authority in the eyes of your followers. Common sense tells us that most individuals hired or elected into a leadership position have a proven skill set that got them there. With that understanding, when transitioning into a new position, “There are systematic methods that you can employ to both lessen the likelihood of failure and reach the breakeven point faster.” (Watkins, 2003, p.4) The breakeven point referenced above is calculated from research that when you first arrive in an organization, you are actually absorbing resources from that organization—you are a liability. At that stage, even though you are investing your energy into the organization, the organization is investing its energy in you. The breakeven point is the moment in time where you stop consuming from the organization as a liability and have repaid your debt as a liability and your energy becomes a balanced asset. (Watkins, 2003) The key, then, is to match your take charge strategy, which is built on the leadership principles that you have developed as your own personal skill set, and from there design it to adapt to the new situation in which you are investing your energy. It takes approximately ninety days to complete the consumption process and meet the break even point. In order to capitalize on your energy and time, there are ten key transition challenges that your strategic planning needs to incorporate as junctures towards success. (Watkins, 2003)

...has filed sex discrimination charges with the EEOC. Explain the steps the EEOC will use to process the charge; include Nancy's options during the process. Post 1 Since Ms. Conrad believes that I have turned her down for the position as sales supervisor due her gender, she has decided to fill discrimination charges to the EEOC. The EEOC is Equal Employment Opportunity Commission. The steps to follow are first, Ms. Conrad should file a discrimination complaint or a charge form with the EEOC with 180 days of the alleged incident. Once the complaint is properly filed the employer will receive a copy of the charges within 10 days from the day filed. “Both parties, the plaintiff (employee) and the defendant (organization), must be prepared to support their beliefs or actions.” (Snell, 2013, P. 121). In some states the FEPA, which is the Fair Employment Practice Agency, take control of the case to find a resolution before action is taken by the EEOC. If the FEPA cannot find a resolution or 60 days pass, which is the deferral period time, then the EEOC takes back the case. Therefore, the next step is that a very thorough investigation is done by the EOSs. The EOSs are the equal opportunity specialists who are very experienced and well trained for these types of cases. Now there are three things that can happen once all the investigation is done and the EOSs along with the EEOC have all the required evidence, one the EEOC can determine to dismiss the charges, another option is that there...

...religion, sex (including pregnancy), national origin, age (40 or older), disability, genetic information, or retaliation, you first have to file a charge with one of our field offices (unless you plan to bring your lawsuit under the Equal Pay Act, which allows you to go directly to court without filing a charge). We will give you what is called a “Notice-of-Right-to- Sue” at the time we dismiss your charge, usually, after completion of an investigation. However, we may dismiss for other reasons, including failure to cooperate in an investigation. This notice gives you permission to file a lawsuit in a court of law. Once you receive a Notice-of-Right-to- Sue, you must file your lawsuit within 90 days. We cannot extend this deadline except when the District Director gives the parties a written notice of intent to reconsider before the deadline for filing a lawsuit. If you don’t file in time, you may be prevented from going forward with your lawsuit. Exceptions When Filing a Lawsuit If you plan to file an age discrimination lawsuit, you won’t need a Notice of Right-to-Sue to file in court. You can file anytime after 60 days have passed from the day you filed your charge (but no later than 90 days after you receive notice that our investigation is concluded). If you plan to file a lawsuit under the Equal Pay Act, you don’t have to file a charge or obtain a Notice of Right-to-Sue...

Shouldice Hospital Operations Assessment

...Shouldice Hospital: Operations Assessment [pic] Shouldice Hospital has been devoted to repairing hernias for over half a century. Although the Shouldice system has led to great competitive positioning, the hospital is falling victim to its own success. Demand for Shouldice services is so much higher than its current capacity of 89 beds that it is in a constant state of operations backlog, which grows by 100 patients every 6 months. Thus, Shouldice needs to find a solution to its single most critical question – how to expand the hospital’s capacity while simultaneously maintaining quality control of service delivery. The analysis below is designed to assess the current operations at the hospital, in addition to explaining our recommendation that Shouldice should invest $4MM in a new unit, which will increase bed capacity by 50% and require its surgeons to perform Saturday surgeries. As the financial analysis shows, this change will allow Shouldice to capture unmet demand without compromising its unique system of patient and employee care. Lastly, our recommendation will be also juxtaposed to other options we evaluated as potential solutions, but that neither make financial sense nor solve the current dilemma for the hospital. Hospital Overview Shouldice Hospital is a “focused factory:” a hospital with a specific area of expertise that gives it competitive strength resulting in lower cost, higher quality service for its patients, and better pay for and...

Plea Bargaining

...Plea Bargaining A Plea bargain is an agreement between the prosecutor and the defendant in a criminal case where the defendant pleads guilty to a certain charge in exchange for a lesser penalty from the prosecutor. Plea bargaining brings many benefits to the prosecutor and the court system but also comes with much criticism. Normally the judge will offer a plea bargain when the defendant knowingly waives his/her rights and admits that their guilty. The role of the plea bargain in the criminal justice system is often misunderstood and frequently critiqued. A plea bargain helps to avoid lengthy trials and arguably helps to manage the caseload that passes through every court but they are used at the cost of giving potential offenders more lenient sentencing and in some cases, risking the conviction of innocent defendants. Despite holding a rather unfavorable view in the eyes of the public, plea bargains are used in approximately 90% of cases involving conviction (Meyer and Grant, 2003). There are two types of plea bargains, the “charge bargain” and the “sentence bargain”. A charge bargain allows a defendant to plead guilty to a lesser charge or only a few of the charges brought against them. A sentence bargain is when the defendant knows ahead of time what the sentence will be if they plead guilty. (Larson, 2000, p. 1) 90 percent of criminal cases are negotiated through plea bargains, ("Plea bargain pro’s and con’s", 2009, p. 1) which in turn, is beneficial to all the players...
