March 24, 2013 Abstract
This essay will attempt to delve into the consequences of technological advancement and the subsequent measures taken to balance them.Electronic Funds Transfer Act, 1978According to "Debt.org" ” The Electronic Fund Transfer Act (EFTA) is a federal law enacted in 1978 to protect consumers when they use electronic means to manage their finances” (Electronic Fund Transfer Act). Electronic fund transfers or EFTs can include any electronic transaction that immediately withdraws money from a consumers’ account. When looking back at a time before electronic banking, it seems amazing that consumers waited patiently in endless lines, filled out tedious paperwork for everything from making a deposit to transferring funds from savings to checking. Over the years, not only has the technology evolved, the consumer has evolved, in part because of the Electronic Funds Act. With the convenience of electronic banking, came the weakness of faceless interactions.In the infancy of electronic banking, consumers were understandably hesitant to relinquish the one-on-one privacy of banking in person. Even ATMs were not the common language they are today. What if something went wrong with the machine or someone gained access to his or her account? It was natural for consumers to become even more uneasy at the thought of accessing their accounts online or paying a bill through an automatic debit. With the emergence of hackers in the early days of the Internet, there was food for fodder. How safe was online or phone banking? The Electronic Funds Transfer Act offers protection over such actions as ATM usage, direct deposit, Pay-by-Phone, online banking, debit card and electronic check conversions ("Debt.org"). It also offers the consumer guaranteed information from banking institutions that protect the consumer from unauthorized use of account information in addition to ways of claiming loss from such situations. * Controlling the Assault of Non-solicited Pornography and Marketing (CAN-SPAM) Act, 2003 * Over time and with the evolution of the World Wide Web, similar situations would require attention. In 2003, President Bush passed the first anti-spam act. According to "The Metropolitan Corporate Counsel" (2004), the “Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003," also known as the "CAN-SPAM Act of 2003," defines a "commercial electronic mail message" ("CEMM") as any electronic mail message, the primary purpose of which is commercial advertisement or the promotion of a commercial product or service (para. 2-4). This includes emails in which the sender intentionally plans on deceiving the receiver or illegally acquired the address. With email becoming such a prevalent medium for communication, consumers were originally trusting of the items they were receiving. It would soon be discovered that many emails were misleading either in their headings or in the content contained in the message, leaving consumers dumbfounded and at a major disadvantage. The CAN-SPAM act of 2003 created a list of prohibited activities including; sending a CEMM with a misleading heading, sending a CEMM that does not contain a viable return address and sending a CEMM to a receiver who has requested to be removed from such transmissions ("The Metropolitan Corporate Counsel", 2004). The sending of unsolicited and pornographic materials is also heavily included in this act. Again, with the advancement of personal computer technology and the sophisticated abilities of a growing community of criminal users, consumers realized that their innocent form of communication was quickly turning into a playground for online scoundrels. The fear of opening an email became true. This act provided an eye opening view for both victims and bullies. By enforcing consequences to these villainous acts, the act had also given consumers an upper hand in dealing with and reporting such activity, providing a safe zone for an increasingly paranoid public. In conclusion, the world is full of terrible and advantageous predators, ready and willing to latch on and exploit what any viable avenue.
