The 53yo claimant has a myriad of medical issues including a lumbar radiculopathy prior to the accident. The uphill battle we face in resolving this particular case is an outstanding child support lien in the amount of $120,000.00. The claimant sustained injuries soft tissue in nature as a result of the collision. We will hold off on reducing the overall value due to PIP offsets and use prior medical condition as leverage to negotiate a reasonable settlement.
