Gender Discrimination occurs when an employee is treated differently because that individual is a woman or a man. Transgender Discrimination is known as gender identity discrimination and is cover under Title VII. Gender Discrimination Applicable Laws ?

Example of Gender Discrimination

In the case where the senior partner asked the hiring manger overtly not to hire pregnant ladies or women under a certain age is illegal. Pregnancy Discrimination Act (PDA) forbids discrimination based on any aspect of employment (U.S Equal employment Opportunity Commission, YYYY). It is important for the hiring manager to inform the senior partner that the recruitment and hiring practices of applicants are subject to government regulation such as requiring employers to recruit from a diverse applicant pool and advertise in way to encourage diverse pool of applicants to apply for vacant positions (Bennett-Alexander & Hartman, 2007).

Example of Racism Discrimination

In the case of Local 28, Sheet Metal Workers v. EEOC 478 U.S., blacks were not allowed to participate in a 4-year apprenticeship training program. This program was designed to teach sheet metal skills, and once completed the apprentices become journeymen for Local 28 members. The New York State Commission for Human Rights determined that the union was in violation of state law and order to impose a 29 percent nonwhite membership goal and a 150,000 fine to be placed in a fund to encourage nonwhite individual members to the apprenticeship program (Bennett-Alexander & Hartman, 2007).
