Procedural History

Eugene Clemons and Dedrick Smith were convicted of the murder of a federal agent that was employed in the performance of his duties, violating 18 U.S.C. Secs 1111 and 1114 stating that any person who kills a DEA officer in the performance of his duties shall be punished under sections 1111 and 1112. Clemons was convicted of using a firearm in the task of a crime of violence. Clemons claims that the evidence presented was insufficient in showing that the victim was a federal agent who was at the time employed in the performance of his duties and that the court abused its discretion in admitting a waiver and confession from Clemons in connection with a juvenile adjudication as evidence.

Naylor Braswell, Althouse’s roommate, accompanied Althouse to the meeting. Braswell and Althouse were riding in an undercover Camaro Z-28 and stopped at a Chevron gas station en route to the meeting. Braswell entered the gas station to obtain a phone number then soon observed an individual, Clemons, sitting in the driver seat pointing a weapon at Althouse’s head. Several gunshots were heard as Althouse exited the vehicle and the Camaro sped away. Althouse died of gunshot wounds shortly

Introduction Our perception of our world changed dramatically on September 11, 2001. Relational exchange arrangements supported by trust are commonly viewed as substitutes for complex contracts in interorganizational exchanges. Many argue that formal contracts actually undermine trust and thereby encourage the opportunistic behavior they are designed to discourage. In this paper, we develop and test an alternative perspective: that formal contracts and relational governance function as complements. Using data from a sample of information service exchanges, we find empirical support for this proposition of complementarity. Managers appear to couple their increasingly customized contracts with high levels of relational governance (and vice versa). Moreover, this interdependence underlies their ability to generate improvements in exchange performance.
