Executive Summary
Wal-Mart is one of the biggest empires in the world. It dominates many markets by providing many different products for the lowest prices guaranteed. You can’t go anywhere without seeing a Wal-Mart, which has more revenue than the entire workforce of Utah. It has revolutionized the world or commerce, through implementing state of the art inventory tracking systems and mastering logistics. Many argue that it has become so successful and powerful from being unethical with its employees. Wal-Mart is currently involved in the largest job discrimination class action lawsuit in U.S. history affecting about 1.5 million women. Wal-Mart also has lawsuits concerning wage and hour violations, executives also admitted to being told by superiors to not pay overtime. It continues to have problems with its labor force in china, forcing them to work seven days a week and paying them less than China’s minimum wage, and having employees work with dangerous chemicals without the “right to know”, as its called in America.

Other than the labor issues, Wal-Mart is a very ethical corporation and well respected. It employs 2.1 million individuals in America and other countries, and also offers work opportunities for the handicapped and disabled. Wal-Mart provides products for a very low price to help the average American family save money and survive off a minimal income. Wal-Mart is involved with many different charitable foundations and helps communities. All of these efforts help with its public image. If Wal-Mart wants to continue to grow as a corporation it must steer away from these unethical practices with its employees as stated below.

* Discrimination against women * Employee disputes over unpaid wages and violations * Abusing oversees labor forces

There are a few recommendations that Wal-Mart should consider to implement into its corporation. Each of these recommendations is feasible and effective.

* Create a even pay scale for men and women to eliminate all pay discrimination against women * There should be more accountability put upon store managers in order to ensure employees are treated fairly and policies are enforced * Promote implementation of China’s labor laws and improve labor conditions

These recommendations will help Wal-Mart put an end to unethical treatment of its employees.

Introduction

Ethical treatment of employees is an issue that resounds in every business and corporation around the world. Governments and workforce leaders have created laws and unions in order to protect the rights and ensure fair treatment of employees. Many large corporations have become targets of allegations of unethical treatment of employees. All of these allegations lead to lawsuits that cost companies millions of dollars a year. Wal-Mart currently spends millions of dollars a year in fighting lawsuits of labor disputes. Wal-Mart is currently involved in the largest job discrimination class action lawsuit in U.S. history affecting about 1.5 million women. The Cost of this case is unknown but could be over a billion dollars.

Wal-Mart is a very ethical corporation and well respected. It employs 2.1 million individuals in America and other countries, and also offers work opportunities for the handicapped and disabled. However, Wal-Mart has been accused of unethical treatment of its employees. An analysis of its behaviors must be done in order to address these claims and the reasoning behind them. Wal-Mart along with many other corporations has a strong influence on the world and communities for better or worse. If Wal-Mart is practicing unethical treatment of its employees it can have long-term effects that will hurt the corporation and destroy its name. There are ways to fix ethical problems in a corporation and many of these solutions must be done in order to maintain and keep an ethical work place for employees, along with keeping a happy and productive workforce.

Although Wal-Mart is already an ethical corporation and employees many pleased employees, it must take a good hard look at what it is doing to ensure that employees are being treated ethically and fairly. It must evaluate itself as a corporation and find ways to improve and eliminate all unethical treatment of its employees. In doing so it will save the corporation billions of dollars a year in legal fees and compensations for violation of labor laws. It will also make the corporation much stronger by bringing trust back to its employees and consumers. Wal-Mart will have a burden lifted off of its shoulders as it puts an emphasis on ethical treatment of its workforce.

Analysis of Wal-Marts Ethical Treatment of Employees

The Company: Wal-Mart Inc.

Wal-Mart first opened in 1962 by Sam Walton with a very simple philosophy. Offer shoppers lower prices than they can get anywhere else. Its first store was opened on July 2, 1962 in Rogers, Arkansas and soon after spread to 24 stores across Arkansas. Wal-Mart soon began to grow and became a publicly owned company in 1970. It continued its growth and devolved state of the art inventory tracking systems to eliminate overhead and master logistics. Because of these efforts Wal-Mart revolutionized the retail world and is looked at today as the ultimate example of retailing. Wal-Mart Corporation is composed of two main outlets Wal-Mart and Sam’s Club. Wal-Mart has had rapid growth ever since it first opened its doors, and now today is the largest retail corporation in the world with 2.1 million employees. It generates more revenue than any publicly owned corporation in the world with 421.8 billion dollars in revenue for 2010.

The Practice: Ethical Treatment of Employees

It is very important that any corporation maintains ethical treatment of its employees. In doing so the corporation will eliminate many problems and financial burdens. Wal-Mart Corporation is one of many corporations that must maintain a high standard of ethical practices because it is constantly in the spotlight.

Ethical treatment of an employee includes many different issues including: Wages and benefits, discrimination and harassment, safe and healthy work environments, and basic labor laws. All of these issues are very important and are abused everyday by corporations. Wal-Mart is already very aware of these issues and puts an effort to uphold workers rights. Wal-Mart has had problems with every one of these issues and is currently facing very big issues regarding discrimination and wages. These issues all can be very destructive to a corporation and to the employees, it is very important that corporations uphold these rights. In doing so it will help the corporation succeed in the marketplace.

Wal-Mart’s Ethical Treatment of Employees
Wal-Mart currently employs 2.1 million employees around the world. It also offers opportunities for handicapped and disabled people to work for them. Wal-Mart provides products for a very low price to help the average American family save money and survive off a minimal income. Wal-Mart is involved with many different charitable foundations and helps employees and communities by giving back to them. Wal-Mart has done a lot of good for a many rural communities and its employees and it has maintained a fairly good image for itself. Many individuals want to work at Wal-Mart and be a part of the corporation. Wal-Mart has many positive benefits that come with employment such as health and wellness and financial benefits. The first unethical practice that Wal-Mart has been accused of is discrimination against woman. As stated Wal-Mart is currently involved in the largest job discrimination class action lawsuit in U.S. history affecting about 1.5 million women. This alone is a very big problem for Wal-Mart and gives strong evidence that changes need to be made in the way Wal-Mart treats its female employees. The current case contains 120 sworn statements made recounting sex discrimination in pay and promotion. This is nothing new to Wal-Mart; before this case had any grounds there were already hundreds of cases very similar to it. Wal-Mart continually has cases brought against it about discrimination of race, sex, and homosexuals. Wal-Mart will spend millions of dollars this year in taking care of and dismissing such cases.

Wage violations and unpaid overtime are two other topics that Wal-Mart has been accused of for a very long time. In past few years, over 100 unfair labor practice charges have been filed against Wal-Mart throughout the country, with 43 charges filed in 2002 alone. Violations include illegally firing workers who attempt to organize a union, unlawful surveillance, threats, and intimidation of employees. Many of these cases were regarding wage violations and unpaid overtime.

The main reason that Wal-Mart was having so many cases against it due to overtime was that it only will pay overtime up to Wal-Mart’s limits. When overtime surpasses the limit, extra wages are no paid until the following month. There also were cases against them because Wal-Mart disguised layoffs to avoid paying severance payments to workers. Workers are abused by management or switched to undesirable jobs until they quit voluntarily. These are a few examples of why Wal-Mart has so many lawsuits over labor disputes. Wal-Mart was also accused of abusing younger workers by making them work longer hours than they should and putting them into unsafe conditions. Many of these lawsuits hold no claim and are only after money. Yet many are valid cases that Wal-Mart should take a good hard look at why there was a problem with the management enforcing the policies.

Wal-Mart has been criticized for the last few years about their labor force in China. It was caught telling workers that they should lie to auditors about certain information, in addition to working people more hours than is humane. The Chinese workers were working seven days a week, which is 11 hours a day or 77 a week. Chinese employees were exposed to poor working conditions where workers inhale large amounts of paper particles without knowing they were in any harm. Chinese workers were also being paid $.051/hour, almost half of the mandatory minimum wage. Wal-Mart was also caught forcing 12 workers to live in cramped dorms All of these offenses are not only unacceptable, but are also a violation for a big business.

There are also issues with how much Wal-Mart pays its employees. Wal-Mart, is a frequent violator of wage and hour laws, now finds itself defending its labor practices in legal battles across the nation. Wal-Mart is currently facing lawsuits alleging that employees were forced to work off the clock and skip lunch and rest breaks while management manipulated time and wage records in order to keep labor costs down. There have also been lawsuits allege that Wal-Mart knew that it was violating the Fair Labor Standards Act and hid evidence of its illegal practices in order to attempt to avoid liability. Wal-Mart average wage of $10.86 per hour, will earn $19,200.48 per year. This falls below the federal governments definition of poverty for a family of four in the contiguous United States, which is $21,200.

Wal-Mart has its fair share of lawsuits and problems like many other corporations. It will continue to have many more in the future and cost the corporation lots of money and time. Many know Wal-Mart as an ethical business, but it must continue to address the issues at hand if it wishes to end the current problems.

Recommendations

Wal-Mart has continued to show the world that they will do whatever it takes to be the best company in the world. It already has a clear focus and an amazing performance record. Wal-Mart has already made an assertive effort to keep a good public image and will continue to do so. In order to keep the general public and its employee’s content it must put an assertive effort towards fixing its current issues. Wal-Mart must find a way to eliminate its discrimination problems. Through gaining the trust and respect of its employees back. Companies that have high moral standards with its employees are more likely to succeed and gain a much stronger workforce. In order for Wal-Mart to fix its current issues it must make a few changes within its company. Although there is no certain solution to fix its problems, listed bellow are a few recommendations on how Wal-Mart could approach its current issue of unethical treatment of employees.

Even Pay Scale

Equality among employees is important for any corporation. Discrimination in the work place is a big issue for many companies and exists everywhere today. There have been many programs, policies, and even laws put in place to eliminate discrimination in the work place. Wal-Mart has maintained an image of a prejudice free work environment until lately. It could eliminate many of its employees claims of sex discrimination if it had an equal pay scale that is based off of performance and time spent as an employee. If Wal-Mart where to make an emphasis to show that all employees, male and female, were treated the same and reviewed for compensation the same it could eliminate the idea that it discriminates against women. Wal-Mart would be able to keep an open policy of letting employees know that this policy doesn’t discriminate against anyone. More Accountability

Wal-Mart has 2.1 million employees in its corporation. It has a daunting task to manage a work force of that magnitude. Wal-Mart has shown that it can manage its employees and be effective doing it. The most effective way to ensure that employees are being treated fairly and ethically is from the top down. Wal-Mart must hold its management accountable for the way it treats employees. It must make sure that managers are enforcing the corporation’s policies and labor laws. Wal-Mart already has an impressive structure and policies to make sure that all of its employees are treated ethically. The way that Wal-Mart will eliminate its problems with unpaid wages and violations is by holding managers accountable for such violations. If an assertive effort is put upon accountability and strict consequences to unethical practices of management, Wal-Mart will eliminate all of its employee ethical problems
China’s Labor Laws and Conditions

China continues to grow into a more developed country every day. Wal-Mart has continued to do great things for China and brings many jobs and revenue to the country. Wal-Mart is currently China’s Fifth largest export of goods. If both China and Wal-Mart would like to build a healthy relationship of trade, both should encourage and promote China’s Labor Contract Law. This is just not a problem for Wal-Mart, but is a problem for the Chinese government. Both parties are responsible for the ethical treatment of the labor force in China. If Wal-Mart chooses to regulate and enforce the current Labor Contract Law it will stand as an example to the entire world that ethical treatment of employees is important to the corporation.

Conclusion

Wal-Mart’s missions began with the concept of focus on small towns and ignore downtown retail districts. Build its own superstore on the outskirts of town. Have all types of goods and sell them at bargain prices. It also focused on being the place to go for quality service and a good shopping experience for a small community. This aim has made Wal-Mart who it is today. It has continued to grow every year since it was founded in 1962 into the world’s largest retailer. Much of Wal-Mart’s success is attributed to the individuals who work for this great corporation. Wal-Mart has continued to bring thousands of jobs to communities and currently employs 2.1 million people. Many of those employees are very content with their employment at Wal-Mart and will continue to be with these changes.

If Wal-Mart will take these recommendations into consideration it will save Wal-Mart millions of dollars a year in legal fees and help to strengthen its work force. It has been proven time and time again in the world of business that if a corporation will treat its employees ethically and fairly, employees will be more productive and respectful to the corporation. Wal-Mart will be able to get through its current lawsuits and fight its critics as it addresses its labor disputes. It will become an example of how a corporation should treat its employees as it follows these recommendations and puts its employees first. As a result Wal-Mart will continue to grow and dominate the retail market with ethical practices.
