1. Is it true, as Jack Carter claims that “we can’t be accused of being discriminatory because we hire mostly women and minorities anyway?
• No, it is not true. Whether you hire women and minorities or not, does not mean you can’t be discriminatory towards those same women and minorities. The questions that are being asked during interviews were very discriminatory. It is not okay to ask applicants about anything that is not work related. It would not even be okay to ask if the women had children as it doesn’t relate to their job. On top of that there is clearly age discrimination in regards to the 73 year old man. Just because he is older doesn’t mean that it is okay to pay him less for the same job.
2. How should Jennifer and her company address the sexual harassment charges and problems?
• The first step should probably be to take a statement from the women that are doing the accusing. The next step I would take would be to interview the manager in question and get his statement. I would then ask other employees if they had noticed any behavior that supports the claims. It may be a good idea to review the security tapes (if there are any) to see if there is anything on them to support what the women are claiming the manager was doing. It also may be a good idea to place the manager on notice that these type of activities are not condoned by the company, and that if any of these activities continue, he could possibly be terminated.
3. How should she and her company address the possible problems of age discriminative?
• Jennifer should first start by finding out how the man became aware of the knowledge that the other employees made more money. If there is a manager that is telling other employees information regarding other employee’s salaries, then there could be an even bigger problem than just the age discrimination. Once that is
