I would want to share if necessary, how unfortunate if was for Barrow to have lost his life. We would emphasize that any life, no matter the person’s actions is a loss. Many others would go on the defensive and say that he was an average unsuccessful African American high- school dropout, but we would not go that route. However, if these facts need to be stated, I would state he was a young African American father that was a high school dropout.
Additional reasons why I would be careful with this incident is because he was shot by being mistaken for someone else (Jerome Lane, who is a young man who lives in that community and has been charged with several recent gun crimes). The four strong defenses for Officer Huntington are that he thought he was confronting a dangerous criminal, he feared for his safety, Barrow looked suspicious and he instructed Barrow to take his hands out of his pockets and Barrow did not listen to Officer Huntington, but ran away from him.
When dealing with a repeated criminal, the officer has to be wise, but quick in decisions.
Yet, I would not share these defenses with the media or respond to questions regarding this, since if we do go to trial, the prosecution would know our potential defense strategies. Which could cost us the trial overall.
If our tactics to avoid a true bill are not successful, we would continue our same media strategy, however if necessary we would change our tactics, such as defend our client in false accusations or assumptions made about him by the media or the prosecution, etc. and declare his innocence in the
