LEGISLATIONS | APPLIED TO MIDKENT COLLEGE | Management of health and safety at work regulations 1999 | Management of health and safety is an essential part of any business whether it is a large or small concern.It is about what actions will be taken if an incident occurs, and what procedures are put in place to avoid those incidents. The aim of these regulations is to encourage a more systematic and better organised approach to dealing with health and safety in all workplaces.The college provide a set of rules in order to avoid any injuries or accidents involving the students and the staff. For example, the college advise the students not to sit in the middle of passages or on the stair case or even not to bring any drinks near the computers or laptops, these rules and regulations help to avoid any potential threat to the students and the college. Managing health and safety involves doing an occasional health inspection. | Health and Safety at work 1974 | This is an Act to make further provision for securing the health, safety and welfare of persons at work, for protecting others against risks to health or safety in connection with the activities of persons at work. An example of how this act is put in place with the college is how all of the computer cables must be neatly out of any passages and contained where no one can trip over it. | The work place regulations 1992 | Some of these regulations fall under the health and safety act of 1974, the regulations make specific requirements for maintenance, ventilation, temperature, lighting, cleanliness, workspace, doors and gates, traffic routes (such as stairs and corridors), loading bays, seating, eating and rest facilities. All of which apply to MidKent college. | Reporting of injuries 1995 | Any injuries or incidents that take place in the College or in any business must be recorded and filed along with an incident report. If .n incident does occur, by law the college must record that incident especially if it is useful to any employees or students who might want to make an appeal. A responsible person must report the incident, responsible persons are generally employers but also include various managers and occupiers of premises. | Control of substances hazardous to health regulations 1994 | Control of substances hazardous to health regulations 1994 covers substances that are hazardous to health such as chemicals, products containing chemicals, fumes, dusts, vapours, mists, nanotechnology, gases and asphyxiating gases and biological agents. The college has to have control over these kind of substances from the gas pipes to diseases students may have the college are responsible of controlling, for example the gas pipes must be checked regularly and if a student has a disease or a contagious sickness they might be sent home until they recover. | Display screen equipment regulations 1992 | Computer workstations or equipment can be associated with neck, shoulder, back or arm pain, as well as with fatigue and eyestrain. This also includes employees in an office environment where screens are used, to be provided with ergonomic equipment for the prevention of injury.As prevention, each employee is entitled to one free eye test throughout their stay of being an employee. | Manual handling operations regulations | The Manual Handling Operational Regulations set specific legal requirements to ensure that employees undertaking manual handling operations at work avoid the risk of injury. The regulations place a specific duty of care on the part on both employers and employees. The regulations apply to all work that involves carrying or holding loads such as lifting boxes, packing goods, or pushing or pulling trolleys. They specify all factors employers must consider if they employ manual workers. These include whether manual tasks involve awkward movements, moving loads over long distances, holding goods that are difficult to grasp and the capabilities of the worker. | Statutory duties of employers and employees relating to health, safety and welfare | It is an employer's duty to protect the health, safety and welfare of their employees and other people who might be affected by their business. This means making sure that the workers and others are protected from anything that may cause harm, effectively controlling any risks to injury or health that could arise in the workplace. If an injury occurs concerning the employee, then the employer has to write an incident report stating exactly what happened, when it happened and how it happened, this document must be safely secured within the college database. | Electricity at Work Regulations 1989 | This legislation places legal implications on employers to ensure the safety of electrical devices in the workplace.Electricity at work regulations In order to comply with the legal requirements of the Electricity at Work Regulations 1989 requires proof that an electrical system is safe, this will be followed out with an assessment by an inspector who will let the company know what needs fixing and the risks of the hazard. If there is an extremely dangerous hazard, sometimes the business might have to stay shut until the problem is resolved. | IMPLEMENTATION IN THE WORKPLACE | APPLIED TO MIDKENT COLLEGE | Legal requirements | Employers have a responsibility to make workplaces as safe as possible. There are two main legal requirements. One requirement is to let all employees know that they are responsible for their own health and safety at work. All employers must look at what risks exist in MidKent College and record the risk assessment. They must appoint employees to apply the Health and Safety measures needed to set up emergency actions to provide clear information and training to employees. | Workplace policies for job roles | The college policy for Kim Owens job role for example is that she has to ensure that each teacher in her department has a DBS certificate it is also her responsibility to make sure that a background check is done on each teacher yearly just to make sure that they have not gained a criminal record in between each check. | Reporting procedures | When any incidents occur within the college, it is a MidKent college procedure to report any of those incidents in case they are needed as any evidence and they will need a witness statement explaining what each person involved saw. | Key personnel responsibility for health and safety | The HR director would be the key personnel in terms of health and safety in this college. There are also other levels of people who would be in charge in each department for example as we go down the structure, Kim and Jane would be considered as the key personnel as they are the fire marshals if a fire were to take place. | Harmful work practices | There are some harmful practices which take place in the college such as students sitting in the passages like on the staircase or even leaving their personal belongings like backpacks and clothing on the floor, this leaves a risk of someone tripping over. As part of preventing this risk the college put up posters and signs reminding people not to practice harmful acts. | Organising own work area | Each employee must ensure that they have a neat safe and clean working area if an employee has an office it is their responsibility only to make sure that they clean and organise their working area. This also applies to the teachers within the college especially they are using any rooms to teach a lesson they are responsible for making sure that the room is left in the state that they entered it in. |

Conclusion
Every organisation must have company policies, rules and regulations which will differ according to the type of organisation however MidKent College have a set of health and safety guidelines which protect the welfare of their employees as well as their students. They have to consider every risk of an accident which could occur, and they apply rules and procedures to prevent these accidents. There are acts to protect the welfare of students, teachers and staff for example everyone must have their ID badges on their neck at all time so that the receptionists and security can identify any trespassers, there are similar procedures which apply to staff also, such as they must have regular training to be reminded of the health and safety policy which apply within the college, and if the staff are not aware of the health and safety policies that can be a risk ion its self. “If workers think their employer is exposing them to risks or is not carrying out their legal duties regards to health and safety, and if this has been pointed this out to them but no satisfactory response has been received, workers can make a complaint to HSE”.
