PENERAPAN MARKETING DI OSCT INDONESIA LATAR BELAKANG
Tumpahan minyak dapat terjadi ketika perusahaan minyak sedang melakukan kegiatan eksplorasi dan produksi minyak, seperti pemeliharaan fasilitas produksi, fasilitas penyimpanan, pemrosesan, kebocoran tangki penyimpanan minyak. Tentunya minyak yang tumpah baik di darat maupun di laut dapat berakibat fatal bagi lingkungan hidup. Hal ini dikarenakan limbah minyak yang tumpah bersifat mudah meledak, mudah terbakar, bersifat reaktif, beracun, serta dapat menyebabkan infeksi.
Akibat yang ditimbulkan dari terjadinya pencemaran minyak bumi di laut adalah: 1. Membunuh flora-fauna yang terkena limbah minyak. Flora fauna yang mati dapat menyebabkan pemanasan global. 2. Rusaknya estetika pantai akibat bau dari material minyak. Residu berwarna gelap yang terdampar di pantai akan menutupi batuan, pasir, tumbuhan dan hewan. 3. Kerusakan biologis, dimana limbah minyak dapat mengganggu proses sel pada makhluk hidup hingga kemungkinan terjadinya kematian. Padahal hewan-hewan tersebut dibutuhkan manusia karena memiliki nilai ekonomi dan kandungan protein yang tinggi.

II. RENTAL SERVICES

1.1 REGULASI

Indonesia merupakan negara yang memiliki sumber daya alam yang kaya, salah satu sumber daya alam Indonesia adalah minyak dan gas bumi. Dikarenakan hal tersebut maka banyak perusahaan yang bergerak di industri minyak dan gas bumi beroperasi di Indonesia, perusahaan tersebut dapat dinamakan/disebut Kontraktor Kontrak Kerja Sama (KKKS). Dari rangkaian kegiatan operasinya, kegiatan usaha hulu Minyak dan Gas Bumi (migas) berpotensi menimbulkan risiko pencemaran lingkungan hidup yang disebabkan oleh tumpahan minyak ke komponen lingkungan darat maupun perairan.

Berdasarkan Undang-undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi pasal 40, dinyatakan bahwa KKKS menjamin keselamatan dan kesehatan kerja serta pengelolaan lingkungan hidup di samping juga harus bertanggung jawab dalam pengembangan lingkungan dan masyarakat setempat. Pengelolaan lingkungan hidup yang dimaksud adalah kewajiban melakukan pencegahan dan penanggulangan pencemaran serta pemulihan atas terjadinya kerusakan lingkungan hidup di darat maupun di perairan. Badan Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (BPMIGAS) berkewajiban melakukan fungsi pengawasan terhadap operasional kegiatan usaha hulu migas yang dilaksanakan oleh KKKS. Dengan diberlakukannya Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, maka BPMIGAS merasa perlu memiliki suatu pedoman umum yang mengatur tata kerja kegiatan operasi Penanggulangan Tumpahan Minyak di wilayah kerja KKKS baik Eksplorasi dan/atau Produksi sebagai upaya kesiapsiagaan dalam menghadapi risiko tumpahan minyak. Pedoman tersebut dinamakan PEDOMAN TATA KERJA Nomor. PTK-005/BP00000/2011 (Revisi –01) TENTANG: PENANGGULANGAN TUMPAHAN MINYAK (PTK 005).
PTK 005, KKKS juga harus mematuhi 007 REVISI-1/PTK/IX/2009 (PTK 007). Pedoman tata kerja ini dibuat untuk memberi suatu pola pikir, pengertian dan pedoman pelaksanaan teknis serta administratif dalam pengelolaan rantai suplai. Dalam PTK 007 Produksi dalam negri diutamakan, Pendayagunaan Produksi dan Kompetensi Dalam Negeri yang diwujudkan sebagai Tingkat Komponen Dalam Negeri (TKDN) barag/jasa dimana paramater ini memprioritaskan barang produksi dalam negeri.
KKKS mematuhi PTK yang dikeluarkan BPMIGAS, dan kedua PTK tersebut membuat perusahaan KKKS seperti ExxonMobil, HESS, CNOOC, Mitra Energy Limited, Chevron dll bekerjasama dengan PT OSCT INDONESIA.

1.2 EQUIPMENT CUSTOMIZATION

Selain meningkatkan jumlah equipmentnya, peralatan-peralatan penanggulangan tumpahan minyak PT OSCT INDONESIA disesuaikan dengan keadaan iklim dan minyak di Indonesia. Contohnya adalah Oil Boom SL-10. SL 10 adalah Oil Boom yang disesuaikan dengan keadaan Indonesia, dimana biasanya KKKS memiliki proyek di pantai dan daratan. Dikarenakan memiliki divisi teknikal sendiri maka PT OSCT INDONESIA dapat melakukan maintenance peralatan sehingga pelanggan tidak takut untuk bekerjasama perushaaan OSCT INDONESIA.

Finding Potential Users Marketing di OSCT harus dapat menemukan User yang tepat untuk menginformasikan mengenai kapabilitas OSCT INDONESIA. Posisi user biasanya HSE, Procurement, dan Operation Manager pada perusahaan. Listening to Users Begitu sudah mendapatkan user yang tepat, maka kita memberikan presentasi dan biasanya User akan menjelaskan kebutuhan mereka mengenai Oil Spill namun biasanya user tidak begitu mengerti tahapan Oil Spill sehingga Marketing harus memberikan informasi sesuai dengan kenyataan yang ada. Convincing Untuk meyakinkan User biasanya Marketing harus dapat memberikan informasi yang tepat dan benar. Contohnya adalah informasi tahapan dalam PTK 005 dan 007, memberikan informasi teknis yang benar serta memberikan rekomendasi, sehingga User dapat merasa percaya dengan Marketing. Discussion Setelah mendengarkan dan meyakinkan User, maka tahap yang biasanya dilakukan adalah diskusi kebutuhan. Karena User sudah “benar” mengetahui kebutuhannya. Tahap diskusi adalah untuk melakukan penyesuaian kerjasama. Running the Project Setelah mendapatkan semua informasi dari User mengenai site operasi, kebutuhan peralatan, jumlah produksi minyak dsb. Maka OSCT INDONESIA memobilisasi peralatannya ke site User (pekerjaan dimulai) hingga pekerjaan ditutup (Demobilisasi). Maintain Client Setelah pekerjaan selesai, maka User harus dapat menjaga hubungan baik dengan klien. Seperti yang diketahui sebuah perusahaan minyak dapat beroperasi di beberapa tempat dengan waktu yang berbeda, maka selalu ada proyek untuk Marketing apabila “dekat” dengan User. ---------------------------------------------------------END-----------------------------------------------------

Arbitrase - (Court of Arbitrationfor Sport/CAS)

Arbitrase adalah penyerahan sengketa secara sukarela kepada pihak ketiga yang netral serta putusan yang dikeluarkan sifatnya final dan mengikat. Badan arbitrase dewasa ini sudah semakin populer dan semakin banyak digunakan dalam menyelesaikan sengketa-sengketa nasional maupun internasional. Penyerahan suatu sengketa kepada arbitrase dapat dilakukan dengan pembuatan suatu compromis, yaitu penyerahan kepada arbitrase suatu sengketa yang telah lahir; atau melalui pembuatan suatu klausul arbitrase dalam suatu perjanjian sebelum sengketanyalahir (clause compromissoire). Pemilihan arbitrator sepenuhnya berada pada kesepakatan para pihak. Biasanya arbitrator yang dipilih adalah mereka yang telah ahli mengenai pokok sengketa serta disyaratkan netral. Ia tidak selalu harus ahli hukum. Bisa saja ia menguasai bidang bidang lainnya. Ia bisa insinyur, pimpinan perusahaan (manajer), ahli asuransi, ahli perbankan, dan lain-lain. Setelah arbitrator ditunjuk, selanjutnya arbitrator menetapkan terms of reference atau ‘aturan permainan’ yang menjadi patokan kerja mereka. Biasanya dokumen ini memuat pokok masalah yang akan diselesaikan, kewenangan arbitrator (jurisdiksi) dan aturan-aturan (acara). Sudah barang tentu muatan terms of reference tersebut harus disepakati oleh para pihak. Seperti tersebut di atas, putusan arbitrase sifatnya mengikat dan final.

Dalam Olahragapun Hukum Arbitrase diterapkan, hal ini dikarenakan agar kegiatan olahraga dapat berjalan dengan tertib. Terlebih lagi perkembangan sengketa olahraga yang telah melibatkan subjek hukum lintas negara membutuhkan sebuah lembaga penyelesaian sengketa olahraga yang bersifat internasional. Untuk itulah, masyarakat olahraga internasional membentuk Lembaga Arbitrase Olahraga (Court of Arbitrationfor Sport/CAS) pada tahun 1984 via Komite Olimpiade Internasional (International Olympic Committee/IOC) dengan tujuan ingin menciptakan sebuah lembaga netral dan tidak memihak yang mampu menyelesaikan sengketa olahraga.

CAS adalah lembaga internasional non pemerintah yang memiliki kewenangan untuk menyelesaikan sengketa olahraga. Kewenangan untuk menyelesaikan sengketa olahraga tersebut didasarkan dari kesepakatan para pihak yang bersengketa. Kesepakatan itu bisa berbentuk klausul arbitrase dalam statuta federasi olahraga, kontrak atau kesepakatan yang dibuat saat sengketa terjadi. Kewenangan ini biasa disebut kewenangan arbitrase biasa (ordinary arbitration) Kewenangan lain CAS adalah sebagai lembaga terakhir (banding) untuk menyelesaikan sengketa yang terjadi antara pihak yang ingin menggugat putusan federasi olahraga yang memang diatur dalam statuta federasi olahraga tersebut. Kewenangan ini lazim disebut arbitrase banding (appeal arbitration)

Selain melalui forum arbitrase, CAS juga dapat menyelesaikan sengketa olahraga melalui forum mediasi. Metode ini bersifat terbatas, yaitu bahwa mediasi hanya dapat dilakukan pada sengketa yang masuk dalam kategori arbitrase biasa (ordinary arbitration) dan tidak dapat menyelesaikan sengketa disiplin serta doping. Forum mediasi ini bersifat informal dan tidak mengikat (non-binding). Kewenangan untuk membentuk forum mediasi juga didasarkan kesepakatan para pihak yang bersengketa. Selain dua kewenangan tersebut, menurut Carter, CAS juga dapat memberi nasihat hukum (advisory opinion) yang diminta oleh federasi internasional, komite olahraga nasional dan IOC.

Kasus
PERSIPURA dengan PSSI

Sengketa bermula dari tidak disertakannya Persipura ( Klub Sepak Bola Indonesia) mengikuti LCA (Liga Champions Asia) 2012 oleh PSSI dipenghujung November 2011. Padahal hak mengikuti LCA 2012 adalah sah milik Persipura sebagai juara Liga Super Indonesia 2011. Putusan tidak menyertakan Persipura dalam LCA 2012 merupakan bentuk hukuman (disiplin) PSSI karena Persipura mengikuti Liga Super Indonesia (2012) yang dianggap sebagai liga illegal oleh PSSI. AFC menerima putusan PSSI tidak mendaftarkan Persipura di LCA tapi tidak bisa menerima usulan PSSI mengajukan Persija untuk mengganti posisi Persipura. Atas pertimbangan itulah Persipura ingin menuntut hak-nya dan menggunakan jalur CAS untuk memastikan apakah putusan PSSI/AFC tersebut benar.

Jika melihat yurisdiksi dari CAS maka gugatan yang dimasukan oleh Persipura telah memenuhi syarat. Pertama, Pasal 62 (1) statute FIFA menyebutkan bahwa CAS memiliki kewenangan untuk menyelesaikan sengketa yang berhubungan dengan FIFA, anggota, konfederasi, liga, klub, pemain, staff, agen pertandingan dan agen pemain yang berlisensi. Oleh karena PSSI dan Persipura merupakan, secara tidak langsung, bagian dari anggota, liga dan klub yang diakui FIFA maka gugatan yang diajukan Persipura sah.

Kedua, gugatan yang diajukan oleh Persipura kepada CAS jatuh pada kewenangan divisi arbitrase banding karena mempersoalkan putusan PSSI/AFC yang tidak mengikutsertakan Persipura dalam LCA 2011/2012. Selain mengajukan gugatan banding, Persipura juga mengajukan provisional measures yang bisa jadi disebabkan adanya kondisi mendesak yang harus diputus oleh Presiden divisi gugatan banding.

Putusan sela telah dikeluarkan oleh CAS pada tanggal 1 Februari 2012, atas dasar situasi yang mendesak karena jadwal playoff LCA yang harus diikuti oleh Persipura pada 11 Februari nanti melawan Adelaide United FC. Adanya putusan sela ini mengharuskan PSSI/AFC juga Adelaide United FC menggelar pertandingan kualifikasi tersebut. CAS kemudian mengeluarkan putusan sela yang memperbolehkan Persipura bermain. Persipura bermain melawan Adelaide United dan kalah 3-0.

Namun akhirnya, Pengadilan Arbitrase untuk Olahraga (CAS) akhirnya mengeluarkan keputusan atas gugatan Persipura Jayapura pada Persatuan Sepakbola Seluruh Indonesia. Hasilnya, CAS membatalkan kasus tersebut. Pada surat keputusan tertanggal 27 April 2012 tersebut yang ditanda tangani oleh Presiden CAS Romano Subiotto tersebut, CAS mengeluarkan lima butir keputusan.

Pertama adalah menghentikan kasus Persipura Jayapura melawan PSSI, Konfederasi Sepakbola Asia (AFC), dan Adelaide United. "Kedua, CAS memutuskan biaya perkara ditanggung oleh empat pihak yang bersengketa, dengan komposisi PSSI dan AFC menanggung masing-masing 40 persen, sementara Persipura dan Adelaide United menanggung masing-masing 10 persen," demikian disampaikan oleh Romano. Ketiga, PSSI dan AFC diwajibkan membayar 5.000 Swiss Franc masing-masing pada Persipura dan Adelaide United sebagai kompensasi biaya legal. Butir keempat menyatakan bahwa panel CAS tidak memiliki wewenang untuk membuat keputusan yang diakibatkan oleh pelaksanaan putusan baik dari putusan sela maupun putusan akhir.

Persipura juga menarik gugatan tersebut karena akhirnya diperbolehkan main di LCA. Keputusan CAS ini berarti menguatkan penarikan gugatan tersebut.CAS juga menyatakan bahwa keputusan ini adalah final, yang berarti tidak bisa dibanding dan harus dijalankan oleh semua pihak terkait.
