5. How would you define an unreasonably dangerous product?
In order for a product to be considered unreasonably dangerous it must have a defect of some sort. There are four types of defects a court recognizes that would brand a product as defective and there for unreasonably dangerous. These imperfections as follows: when there is a fault in the products design, an error in the product manufacture/assembly, improper product maintenance, and manufacturer or seller’s failure to warn.
6. Explain how errors in product manufacture/assembly make a product unreasonably dangerous for product liability purposes.
The purpose of product liability is to help defend and protect patrons from products that prove to be dangerous and holding the product’s manufacturer accountable. When a product is assembled incorrectly missing a critical step along the way it could result in an unreasonable amount of danger. A common example of this would be a manufacturer recall on a vehicle. The defect can be minor in most cases but in some they can have collateral damage before the defect is discovered. These malfunctions forces a thorough inspection of the vehicle to determine who involved in the construction of the car should hold the product liability. These particular defects would not only cause injuries or even death to …show more content…
Explain how assumption of risk operates as a defense to product liability.
Assumption of risk is defined as the plaintiff’s voluntary assumption of a known risk with a full appreciation of the dangers involved in facing that risk. In products liability cases the plaintiff is the ultimate user. The ultimate user’s assumption of risk can be considered a protection for the defendant when the plaintiff ignores a discovered defect and uses the product while knowing of its dangerous condition, fails to maintain the product properly, and/or fails to follow instructions or heed warnings for safe product

...Week 3 Learning Team Assignment – Understanding Contract Law, Risk and Opportunities Cynthia M. Cervantes Myphuong Le Karl Limpin Laura Semmler Cezner Velez Business Law 531 University of Phoenix Dr. Maurice Rosano, MBAM, JD May 30, 2009 Contract Law in Private Enterprise Discuss the importance of contract law to the private market system. How does Contract law provides flexibility and precision in business dealings? Response: One of the most common legal transactions a business will be involved in is a contract. Contracts are governed by laws in the state where the contract is made. Sound business agreements will result with a basic understanding of contract law. Businesses must be able to rely on commitments in order to grow their business. Contract law also provides legally enforceable agreements in the event that a dispute arises. Contract law provides flexibility by allowing the formalized agreement between two or more parties to relate to any particular subject. Contracts can cover an extremely broad range of matters, including the sale of goods or real property, the terms of employment or of an independent contractor relationship, the settlement of a dispute and ownership of intellectual property developed as part of a work for hire. Contracts provide precision in their ability to be written to an exact specification. Sources of Contract Law (a) What is meant by the common law of contracts? (b) What is the UCC? Response:...

Accounting Job Costing

...ch05.qxd 9/27/04 4:19 PM Page 174  CHAPTER Q1 Q2 Q3 Q4 Q5 Q6 Job Costing In Brief Custom products and services, which are produced singly or in small batches, need to be valued for financial statements, tax reporting, and management monitoring. Job costing is an accounting method used to assign product costs to custom products or services. In job costing, direct costs are traced and overhead costs are allocated to individual jobs. Sometimes defects occur in custom products. Defective units can sometimes be reworked. The costs for both spoilage and rework need to be accounted for, as does the cost of scrap that arises from production. This Chapter Addresses the Following Questions: How are costs assigned to customized goods and services? How is overhead allocated to individual jobs? What is the difference between actual costing and normal costing? What are the uses and limitations of job cost information? How are spoilage, rework, and scrap handled in job costing? What are the quality and behavioral implications of spoilage? ch05.qxd 9/27/04 4:19 PM Page 175 BOMBARDIER: CUSTOM MANUFACTURING n 1942, the Canadian company L’AutoNeige Bombardier Limitée began manufacturing tracked vehicles for snow-covered terrain. ...JIT Just in time (JIT) is a production strategy that strives to improve a business return on investment by reducing in-process inventory and associated carrying costs. Just-in-time production method is also called the Toyota Production System. To meet JIT objectives, the process relies on signals or Kanban (看板 Kanban?) between different points in the process, which tell production when to make the next part. Kanban are usually 'tickets' but can be simple visual signals, such as the presence or absence of a part on a shelf. Implemented correctly, JIT focuses on continuous improvement and can improve a manufacturing organization's return on investment, quality, and efficiency. To achieve continuous improvement key areas of focus could be flow, employee involvement and quality. Quick notice that stock depletion requires personnel to order new stock is critical to the inventory reduction at the center of JIT. This saves warehouse space and costs. However, the complete mechanism for making this work is often misunderstood. For instance, its effective application cannot be independent of other key components of a lean manufacturing system or it can "...end up with the opposite of the desired result." In recent years manufacturers have continued to try to hone forecasting methods such as applying a trailing 13 week average as a better predictor for JIT planning;  however, some research demonstrates that basing JIT on the presumption of stability is inherently flawed. ------------------------------------------------- ...

Collaborates with Your Competitors

... Welcome to the new HBR.org. Here’s what’s new. Here’s an FAQ. COMPETITION Collaborate with Your Competitors—and Win by Gary Hamel, Yves Doz, and C.K. Prahalad FROM THE JANUARY 1989 ISSUE C ollaboration between competitors is in fashion. General Motors and Toyota assemble automobiles, Siemens and Philips develop semiconductors, Canon supplies photocopiers to Kodak, France’s Thomson and Japan’s JVC manufacture videocassette recorders. But the spread of what we call “competitive collaboration”—joint ventures, outsourcing agreements, product licensings, cooperative research—has triggered unease about the long-term consequences. A strategic alliance can strengthen both companies against outsiders even as it weakens one partner vis-à-vis the other. In particular, alliances between Asian companies and Western rivals seem to work against the Western partner. Cooperation becomes a low-cost route for new competitors to gain technology and market access.1 Yet the case for collaboration is stronger than ever. It takes so much money to develop new products and to penetrate new markets that few companies can go it alone in every situation. ICL, the British computer company, could not have developed its current generation of mainframes without Fujitsu. Motorola needs Toshiba’s distribution capacity to break into the Japanese semiconductor market. Time is another critical factor. Alliances can provide shortcuts for Western companies racing to improve their production...

...design and build airplanes. The 777 is the first jet that Boeing has created using this methodology. The changes were very dramatic and encompassed many areas, including technical, organizational and administrative changes. Boeing is touting the 777 as more than just a product, but as a new process. Although the technical innovations were numerous, what made the 777 project unique were the other changes Boeing instituted for this design/build effort. It was the first 100% digitally designed and pre-assembled airplane made by Boeing. Concurrent engineering, the concept of “Working Together”, was an integral part of the new philosophy and nearly 240 Design/Build teams were used through-out the process. The teams included design, manufacturing, customer and supplier personnel from the start. Designing and building a new commercial jet airliner is a long, five to ten years, and infrequent, one or two per decade, process. As such, it is crucial to document the design/build process for future projects, especially one that had so many “firsts”. A multimedia case study is an ideal vehicle for teaching engineers within Boeing as well as engineering students the design/build process of a large and complex product....

...to see that his heart was not in his work. He resorted to shoddy workmanship and used inferior materials. It was an unfortunate way to end his career. When the carpenter finished his work and the builder came to inspect the house, the contractor handed over the house key to the carpenter. “This is your house,” he said, “it is my parting gift to you.” What a shock! What a Shame! If only he had known he was building his own house, he would have done it all so differently. Now he had to live in the home he built none too well. (Modified from LIVING WITH HONOUR by SHIV KHERA) Do we find ourselves in similar situations as the carpenter? Moving through our work hours fast paced, driven to “get the job done”, without much thought to moral values. How do we regain our focus as individuals and organizations? This is the challenge for the employee and the employer. Ethics are fundamental standards of conduct by which we work as a professional.
