PROCEDURA OPERATIVA PER LA GESTIONE DELLE COMUNICAZIONI AL GSE DI FINE LAVORI DEGLI IMPIANTI FOTOVOLTAICI (Legge n. 129 del 13/08/2010)

1. Applicazione della legge n. 129 del 13 agosto 2010

L’articolo 1- septies della legge 13 agosto 2010, n. 129 recita: “1. Le tariffe incentivanti di cui all'articolo 6 del decreto del Ministro dello sviluppo economico 19 febbraio 2007, recante criteri e modalità per incentivare la produzione di energia elettrica mediante conversione fotovoltaica della fonte solare, pubblicato nella Gazzetta ufficiale n. 45 del 23 febbraio 2007, sono riconosciute a tutti i soggetti che, nel rispetto di quanto previsto dall'articolo 5 del medesimo decreto ministeriale, abbiano concluso, entro il 31 dicembre 2010, l'installazione dell'impianto fotovoltaico, abbiano comunicato all'amministrazione competente al rilascio dell'autorizzazione, al gestore di rete e al Gestore dei servizi elettrici - GSE Spa, entro la medesima data, la fine lavori ed entrino in esercizio entro il 30 giugno 2011. 1-bis. La comunicazione di cui al comma 1 è accompagnata da asseverazione, redatta da tecnico abilitato, di effettiva conclusione dei lavori di cui al comma 1 e di esecuzione degli stessi nel rispetto delle pertinenti normative. Il gestore di rete e il GSE Spa, ciascuno nell'ambito delle proprie competenze, possono effettuare controlli a campione per la verifica delle comunicazioni di cui al presente comma, ferma restando la medesima facoltà per le amministrazioni competenti al rilascio dell'autorizzazione”.

Al fine di applicare le disposizioni della suddetta legge il GSE ha definito la presente procedura operativa contenente le modalità per la presentazione della documentazione di fine lavori.

Si rappresenta, inoltre, che, in conformità a quanto disposto al comma 1) art. 5 “procedure per l’accesso alle tariffe incentivanti” del DM 19/02/07, il soggetto che intende realizzare un impianto fotovoltaico e accedere alle tariffe incentivanti deve, prima della realizzazione dell’impianto, avere richiesto la connessione alla rete al gestore della stessa rete.

2. Definizione di fine lavori per l’impianto fotovoltaico
2.1. Fine lavori dal punto di vista strutturale

Oltre ai lavori che determinano la funzionalità elettrica, nel seguito descritti dettagliatamente, è necessario che siano completate tutte le opere edili e architettoniche connesse all’integrazione tra l’impianto e il manufatto in cui esso è inserito, in riferimento alla specifica tipologia installativa per la quale sarà richiesta al GSE la pertinente tariffa. L’impianto deve possedere già al momento della dichiarazione di fine lavori le caratteristiche necessarie per il riconoscimento dell’eventuale grado d’integrazione architettonica (parziale o totale) previsto dal DM 19/02/07, così come indicato nella “Guida per l’integrazione architettonica – Ed. Aprile 2009” e successive precisazioni “Chiarimenti in merito all'integrazione architettonica”; entrambi i documenti sono disponibili sul sito WEB del GSE (www.gse.it) Modifiche alle caratteristiche architettoniche dell’impianto eseguite dopo la data di fine lavori non saranno prese in considerazione ai fini della determinazione della pertinente tariffa e potranno comportare la decadenza della tariffa.

2.2 Fine lavori dal punto di vista elettrico

Ai fini della verifica dei requisiti necessari per accedere ai benefici della L. 129/10 si adottano nella presente procedura le definizioni di impianto di produzione e di impianto per la connessione coerenti con quelle del nuovo Testo Integrato delle Connessioni Attive (TICA) - delibera AEEG ARG/elt 125/10 e con il suo allegato A - recante “Modifiche e integrazioni alla deliberazione dell’Autorità per l’energia elettrica e il gas ARG/elt 99/08 in materia di condizioni tecniche ed economiche per la connessione alle reti con obbligo di connessione di terzi degli impianti di produzione”:

impianto di produzione è l’insieme delle apparecchiature destinate alla conversione dell’energia fornita da una qualsiasi fonte di energia primaria in energia elettrica. Esso comprende l’edificio o gli edifici relativi a detto complesso di attività e l’insieme, funzionalmente interconnesso: - delle opere e dei macchinari che consentono la produzione di energia elettrica - dei gruppi di generazione dell’energia elettrica, dei servizi ausiliari di impianto e dei trasformatori posti a monte del/dei punto/punti di connessione alla rete con obbligo di connessione di terzi. L’interconnessione funzionale consiste nella presenza e nell’utilizzo di opere, sistemi e componenti comuni finalizzati all’esercizio combinato e/o integrato degli elementi interconnessi, quale a titolo esemplificativo convertitori di tensione, trasformatori di adattamento/isolamento, eventuali trasformatori elevatori, cavi di collegamento, etc. In particolare per un impianto fotovoltaico devono risultare installati ed elettricamente collegati i seguenti componenti: moduli fotovoltaici, strutture di sostegno, convertitori di tensione, cavi di collegamento tra i componenti d’impianto, dispositivi di protezione, quadri elettrici, dispositivi di isolamento, adattamento e sezionamento, quadro per la posa del misuratore di produzione. Ciascun impianto può a sua volta essere suddiviso in una o più sezioni. Queste, a loro volta, sono composte da uno o più gruppi di generazione. Inoltre è possibile distinguere l’impianto per la connessione, come:

-

impianto di rete per la connessione è la porzione d’impianto per la connessione di competenza del gestore di rete, compresa tra il punto d’inserimento sulla rete esistente e il punto di connessione;

-

impianto di utenza per la connessione è la porzione d’impianto per la connessione la cui realizzazione, gestione, esercizio e manutenzione rimangono di competenza del richiedente. L’impianto d’utenza per la connessione, a sua volta, può essere distinto in: - una parte interna al confine di proprietà dell’utente a cui è asservita la connessione fino al medesimo confine di proprietà o al punto di connessione qualora interno al predetto confine di proprietà;

- una parte compresa tra il confine di proprietà dell’utente a cui è asservita la connessione e il punto di connessione. Nel caso il punto in cui il punto di connessione è interno al confine di proprietà, tale parte non è presente.

Per gli impianti che possono essere connessi sulla rete di bassa tensione, il Soggetto Responsabile predispone l’uscita del/dei convertitori o trasformatori di adattamento/isolamento per il collegamento alla rete. Per gli impianti di taglia superiore, collegati alla media o alta tensione, è necessario includere nelle attività di fine lavori anche la/e cabina/e di trasformazione utili per l’elevazione di tensione. Dovranno, pertanto, essere completati tutti i locali misure, i locali inverter e tutte le opere edili correlate alle cabine di trasformazione. Deve, infine, essere stato realizzato l’impianto di utenza per la connessione di competenza del richiedente. La definizione di fine lavori non comprende l’impianto di rete per la connessione, anche nel caso in cui il richiedente abbia scelto di effettuare in proprio tali lavori.

3. Procedura per la richiesta di verifica delle condizioni previste dalla legge n. 129 del 13 agosto 2010 I Soggetti Responsabili, che intendono usufruire dei benefici previsti dalla legge n. 129 del 13 agosto 2010, devono collegarsi all’applicazione WEB per il fotovoltaico sul portale messo a disposizione dal GSE (https://applicazioni.gse.it). Attraverso l’attuale sistema informativo, che gestisce gli impianti incentivati ai sensi del DM 19 febbraio 2007, sarà fornita la possibilità al Soggetto Responsabile di accedere alla nuova procedura per la “Comunicazione fine lavori impianto”, inserendo i dati e i documenti relativi all’impianto fotovoltaico. Tutta la documentazione relativa a tale comunicazione deve essere inviata al GSE esclusivamente per via telematica; a inserimento ultimato, al Soggetto Responsabile viene rilasciata una ricevuta elettronica dell'avvenuta ricezione della documentazione da parte del GSE.

L’accesso a questa nuova procedura sarà consentito nell’intervallo temporale compreso tra il 01/12/2010 ed il 31/12/2010.
3.1 Inserimento richiesta di incentivi al GSE – 1° Fase

Durante la fase di inserimento dati per la “Comunicazione Fine Lavori impianto” il Soggetto Responsabile ha la possibilità di caricare informazioni relative all’impianto ivi inclusi: elenco dei moduli (non vincolante); elenco dei convertitori (non vincolante); fotografie dell’impianto (le foto dell’impianto ultimato, devono fornire una visione completa dell’impianto e dei suoi principali componenti, moduli, inverter e trasformatori); dati tecnici dell’impianto; codice POD (non vincolante); codice CENSIMP (non vincolante).

Il sistema genererà in automatico un numero identificativo d’impianto e la scheda tecnica d’impianto.

Il Soggetto Responsabile dovrà caricare sul portale informatico, dopo aver effettuato la conversione in file . pdf, i seguenti documenti: la richiesta di accesso ai benefici previsti dalla legge n.129 del 13 agosto 2010 (formato disponibile sul sito GSE); la scheda tecnica dell’impianto stampata dal portale e firmata dal tecnico abilitato; la copia della richiesta di connessione elettrica al gestore di rete territorialmente competente; il progetto definitivo dell’impianto (ivi inclusi planimetria, elaborati grafici e schema elettrico); l’asseverazione, redatta e sottoscritta in originale da tecnico abilitato, di effettiva conclusione dei lavori; la copia dei titoli autorizzativi richiesti e ottenuti per la costruzione dell’impianto; la dichiarazione di essere proprietario dell’impianto o autorizzazione del proprietario alla realizzazione dell’impianto; la copia di un documento d’identità in corso di validità del Soggetto Responsabile.

Come già anticipato, l’invio dovrà essere effettuato esclusivamente per via telematica entro la data del 31 dicembre 2010. Al Soggetto Responsabile sarà rilasciata una ricevuta elettronica dell'avvenuta ricezione della documentazione da parte del GSE.
3.2 Completamento richiesta di incentivi al GSE – 2° Fase

A valle dell’entrata in esercizio (ultimati i lavori di connessione, di posa dei gruppi di misura e tutti gli obblighi correlati), il Soggetto Responsabile potrà caricare la data di entrata in esercizio sulla scheda tecnica d’impianto, accedendo all’applicazione web attraverso la sezione “Stato impianti” . A questo punto il Soggetto Responsabile potrà inviare, nel rispetto della tempistica dei 60 giorni dalla data di entrata in esercizio, la richiesta d’incentivo secondo le regole del DM 19 febbraio 2007, allegando gli ulteriori documenti mancanti: richiesta di incentivo (allegato A1 stampato da portale); dichiarazione sostitutiva di atto di notorietà (allegato A4 stampato da portale); certificato di collaudo dell’impianto; copia della comunicazione con la quale il gestore di rete locale ha notificato al Soggetto Responsabile il codice identificativo del punto di connessione alla rete (codice POD, definito all’articolo 37, comma 37.1, della deliberazione n. 111/06); copia della denuncia di apertura di officina elettrica presentata all’UTF (per impianti superiori a 20 kWp); oppure, se l’impianto immette tutta l’energia prodotta nella rete, copia della comunicazione fatta all’UTF sulle caratteristiche dell’impianto (circolare 17/D del 28 maggio 2007 dell’Agenzia delle Dogane: disposizioni applicative del Dlgs 2 febbraio 2007, n. 26). copia del verbale di attivazione del contatore di misura dell’energia prodotta e di connessione alla rete (per impianti inferiori a 20 kWp); copia dei verbali di attivazione dei gruppi di misura; codice CENSIMP (qualora non precedentemente comunicato).

Tutti i documenti di cui sopra dovranno essere convertiti in file .pdf e l’invio dovrà essere effettuato esclusivamente per via telematica.

Al Soggetto responsabile sarà rilasciata una ricevuta elettronica dell'avvenuta ricezione della documentazione da parte del GSE. Solo a valle della valutazione della richiesta di incentivo il GSE provvederà a inviare al Soggetto Responsabile una comunicazione con l’esito della richiesta. Nel caso in cui l’impianto non entri in esercizio entro il 30/06/2011 il Soggetto Responsabile dovrà inviare al GSE una nuova richiesta di incentivazione ai sensi del DM 6 agosto 2010.

4. Sopralluoghi di verifica sugli impianti Il GSE avvierà da subito una campagna di sopralluoghi in sito per verificare la correttezza e congruità delle informazioni fornite. Il Soggetto Responsabile è tenuto a rendere possibile il sopralluogo per la data comunicata dal GSE, pena un possibile esito negativo della verifica e conseguente decadenza del diritto alla tariffa incentivante ed eventuali premi.

5. Sanzioni a fronte di false dichiarazioni Come previsto dal DM 19/02/2007 (art. 11) e DM 6/08/2010 (art.16), fatte salve le altre conseguenze disposte dalla legge, false dichiarazioni inerenti le informazioni fornite comportano la decadenza dal diritto alle tariffe incentivanti ed eventuali premi.
